Oh shit... Hiphoptherobot is actually a Nintendo rep... Gonna say the video is done next week and then give us a Nintendo Direct.

I am fairly certain I remember identical situations happening on other recent consoles and people getting their consoles banned.

Because when your console reaches out to the Nintendo network, or the Playstation Network, or XBL it has to do some hardware authentication to grab updates and stuff. Serial numbers are tracked.

Hoo-doo does have a point, but at the same time I don't know if he gets how devices like this are tracked on a network, or how they operate. They're constantly phoning home and they're constantly sending a hardware ID along with it. They can ban the console, and they can punish the retailer. Where he has a point is that it depends on whether the manufacturer is actively tracking these things, but they absolutely can, and historically have when street dates were broken.
