Nope, I would have assumed so prior to Viacom exiting the games business, but this time around THQ was funding it as a publisher.

That's why they actually think they have any claim at all.

Yeah, a bunch of companies have. South Park Studio's is a little different which is why it has a singled-out response. They all have various degrees of merit I think, for example Games Workshop says that only THQ can be trusted with their IP which seems rather dubious. That makes sense. I was wondering about the claim in the first place.

I doubt they can do much about it even as a publisher.

Oh, and once again, Obsidian can't catch a break. I know it might not be that bad for the studio, but still gives negative vibes.

All this game appears to need is the final push out the door but the whole thing could potentially fall apart or get tied up in a legal quagmire depending on what happens. Hoping for the best outcome possible for Obsidian and SPS.

I would be surprised if this takes too much longer since it's pretty likely THQ won't exist by the end of tomorrow.

I mean once their assets are all sold, unless it's a bulk purchase, who is really left to fight over this? I guess their creditors, but Viacom wants to pay them anyway with the buyback clause.

I have been hyped for this game since its January 2012 reveal. I hope it can find a way to get released this year.

I'm going to assume this game won't be released March 5th after all...I'm sure they won't to avoid anytime near GTA V which we all assume to be released in May.

Would hate for this to get pushed back farther than that

I think it's a mid-summer game at best.
 
What a potential nightmare for one of the best looking games of this year.

Way to jump the gun, other than a teaser trailer which showed about 4 frames of 'gameplay' and some combat animations there is absolutely zero information about it.

There is no way to know how it'll play, it could have the same awful rock paper scissors turn based combat of costume quest for all we know (shudder).

What bad luck for Obsidian. I really like those guys and their games, hopefully a deal is worked out quickly to avoid as much delaying/bad press as possible.

It was already pushed back from March before to a tentative Q2 date I believe.

On November 5, 2012, THQ announced that the game has been delayed to the April 30, 2013.[12] In the gameplay trailer released on December 9, 2012, it was revealed that the pre-order bonus would be the "Good Times With Weapons" pack, which includes the Bulrog Chicken Attack, Cartman's Kick-Ass Sai weapons and the Samurai costume.[13]
Although being stated to be released in April, GameStop and other companies have claimed it will release on March 5, 2013

So who knows really, its prob all up in the air at this point..

The objection PDF states that the deal with THQ was inked mid-2011. Even back then it was clear THQ's future was grim, so Viacom really ought to have gone elsewhere; EA Partners would have been a good fit.

1. THQ keeps the rights but can't pay royalties, if such a thing was agreed upon.
2. If Viacom get the rights for the game, will Obsidian need to re-negotiate the contract?

Oh I hadn't seen that, fair enough :)

I think we'll just need to wait until the auction is over anyway, after all this will end up being published by someone else and the release date could very easily change then.

EDIT: I just looked at the links from the wiki page, I wouldn't put any faith in retailer dates as it was originally planned for March 5 and as for the April date that just comes from the beginning of THQ's next fiscal year.
 
Goodness knows why Viacom had to go with a shitty-ass publisher like THQ in the first place. South Park isn't that low value nowadays, is it?

I was thinking along those lines too. I would like to hear someone from Obsidian shed more light on their situation.

Wasn't it SPS that handpicked Obsidian in the first place? Can't imagine that they would want to screw Obsidian now.

If it's EA Partners they don't have to be Origin only. Kingdoms of Amalur wasn't and Bulletstorm is still on Steam too.
It'd probably screw up my Amazon pre-order though which has a massive GMG-style discount, which would be a shame. Assuming the chaos doesn't just get it canceled anyway, making it a moot point.

I think it has a chance to be a real success.

I honestly put a greater probability on it underperforming than it being a tremendous success. I simply do not think that the South Park brand carries the cache that Viacom/Obsidian/THQ think it does.

Yeah that's what I'm worried about too. I have it preordered on Amazon with coupons that are now expired so if it was cancelled I'd have to deal with CS to get them back.

I think it has a chance to be a real success.

When was the last time any South Park console game was really successful? I can't think of any. The 64 game sucked, as did the Rally game for PSX. Am I missing any? How did that RTS type XBL game do?
