He was giving them GOOD press, he did not say one negative thing.
We're talking about the same corporation that threatened Gaf with legal action because there was negative discussion of Mass Effect 3's plot prior to release.
A "simple email" isn't in their lexicon.
They cant take the servers down while the devs, reviewers and all the staff are working on it for one guy with the console.

That's largely irrelevant. Xbox Live on the Xbox One isn't public until the 22nd. It's the 9th and he's a member of the public, you can imagine why he was banned.

This is pretty much the truth. If it was a game leaking early I think people would be more understanding of bans, but they feel like they already own these consoles and need to know everything about them. We are talking serious money in engineering, product planning, game development, marketing, etc, all invested in an 11/22 street date.
While MS wants the public to know the main features of their console and OS, I think they want a few surprises to be there for the 22nd. Otherwise a lot of excitement can be drawn out. I've seen it happen before where so many details about a game are known before release that people's hype dies down. This guy was giving out new information at an alarming rate. He was connected to a service that is only supposed to be used for a select few MS employees.
Somewhere in that user agreement there had to be a clause about this scenario.
The moral of the story is, if you happen to get your hands on a product weeks before release, don't spend all your time posting info/vids about it unless you expect things to be taken down. Just enjoy it.

Then after, Cerny gets up, Yoshida comes out of nowhere and tags himself in. He tells the dude to prepare for his dualshock 4. Proceeds to ram the dude's ass while reading the PS4 FAQ. Cerny comes back fully naked, says "Get ready for some of my 8GB GDDR5", and starts to work the front. 1080p sex at 60 ballsack slaps per second ensues for hours. Cerny and Yoshida are just about to burst all over the guy's face when Kaz comes out nowhere yelling "$399! $399! $399! $399! $399!". All three proceed to bust ALL KINDS of nuts over the guy's face. Scene fads out...Playstation 4 logo appears.
Hopefully the dood gets unbanned in time for launch. I think anyone with a early PS4 will be ok since PSN is not up yet right?

That doesn't sound like it'd hold much weight in court. Just imagine if the owners manual in your new caddie stated onstar could brick your escalade just because.

I'm not taking Microsoft side really. But the release date is still 2 weeks away and they dont want people to see unfinished assets streamed on Twitch every night and have people remove preorders.
So yeah, they can ban the online of his console, but they better unlock him or else Target will have to give him a new console.

They didnt brick his console. He can still use it to play games. He just cannot go online. So it would be more like they removed his drivers licence because he was using a new road people were not supposed to take.

It's true, but MC's problem isn't really with the consumer it's with the retailer who sent it out. The consumer getting his product bricked with the minimal amount of interaction from their sales/pr team is terrible customer service and terrible pr on MC's part.
Edit: I see he didn't get it bricked but stopped from connecting online. My point still holds though I think.

I don't know how its working for the XB1 consoles but Microsoft could have a whitelist and those who aren't on it would become banned while online.
Only way to not be banned is supply Microsoft with your IP and some other details like the console serial and this is usually for reviewers.
This is what happened in the past with Microsoft so they might be doing the same thing for the XB1.

At this stage Microsoft seem happy to keep committing fraud against legitimate customers. He has a receipt, target shipped early, MS DGAF.
Why anyone would risk buying one of their systems is a mystery, considering your account and/or console can be banned at any time.
