But the story about FDS (represented (in poor English) by Volker, who I'm going to give the benefit of the doubt regarding intentions and mistakes) being tasked with removing the debug fix wherever it's found, accidentally sweeping Durante's file in a DMCA claim (doesn't help that it's popular and perhaps been used alongside the debug by users), is believable. I hope this doesn't hint at one or more branches @ Namco Bandai wanting to nickel-and-dime for custom options/DirectX in an upcoming Dark Souls re-release...most likely this was a mishap of communications, or lack in prior knowledge by a contractor.
We need to add these details to the OP so members can get a better first impression of the situation. I mean, yeah, it's fun to beat on Bamco's doorstep for other reasons, but nothing's confirmed as of yet. Best case scenario, claim gets removed (either through a counter-claim or by FDS + Namco Bandai), one of the community managers reports and confirms this was a misunderstanding, and Durante gets to buy his next boat.
