I have the 8gb model and although they passed the test, a warning popped up stating that my data may not be safe on the stick. A bit odd considering Sandisk make the official 360 usb sticks.

You are wrongly assuming all USB sticks are the same.

Those sandisk's more then likely fail because they have terrible read/write speeds, which is why stuff like that is cheaper then the rest, unless you paid out of your nose for them you got robbed

The first two I bought were from mymemory.co.uk and worked great. The new two come from a major Australian retailer and don't pass the tests. Going back through my Pick-up thread posts I find that there's other differences too:
