Gearbox Sues 3D Realms And Interceptor Over Newly Announced Duke Nukem Title

In early February, 3D Realms and Rise of the Triad developer Interceptor Entertainment teased a new Duke Nukem title for PC and PS4. The game, subtitled Mass Destruction, is described as an “isometric action role-playing game” on the official Facebook page. Today, Gearbox Software filed suit on February 21 against the duo for copyright infringement.

Gearbox purchased the rights to Duke Nukem in February 2010 in order to complete the development of Duke Nukem Forever. That title was in development limbo for over a decade before releasing to middling to low critical response.

Gearbox alleges that 3D Realms is attempting to re-license the intellectual property it already sold, and in the process has infringed on Gearbox’s copyright. Gearbox issued a cease and desist letter to 3D Realms and its leadership, founder Scott Miller and Duke Nukem co-creator George Broussard, on February 13.

A response to that demand was met with an apology and acknowledgement that Gearbox is the only entity with the right to use and/or license the Duke Nukem intellectual property. This is not the first time that Duke Nukem has been at the center of a lawsuit between these parties.

In June 2013, 3D Realms sued Gearbox for breach of contract and failure to fulfill terms of the 2010 asset purchase agreement. That suit was subsequently dropped in September 2013, with an apology issued to Gearbox.

We’ve reached out to 3D Realms and Interceptor for comment. We’ll update should we receive a response.

But they knew they didn't have the rights to Duke anymore and still went on to start making a game with him and teasing it. They should have just made another quick character with a different name. The "financial remedies" and lawsuit portion of this sounds awfully stupid though considering 3D Realms already probably stopped making the game once they got the C&D. Plus they are asking for financial remedies for a game that didn't even release... which is pretty messed up.

Surprised at the number of people being mad at Gearbox for suing to protect their property. If Sony tried to make a Sonic game without Sega's permission, I'm pretty sure most people here would be siding with Sega on suing Sony for that.

I would love to hear how you came to this conclusion when 3d realms is infringeing on gearboxes copyright.

suing people in general kind of sucks? especially when they are doing something more interesting with the license than you are? but I guess the duke ip always sucked anyway.

How naive are you? They paid money for the IP. It's the same as Nintendo suing someone for putting out a zelda game.
 
So, 3D Realms actually acknowledged Gearbox owned the IP and apologized yet Gearbox sues anyways? What happened?

Gearbox is suing because Interceptor is still making their Duke Nukem game that they have no right to make.

Imagine I come to your house and set it on fire. You come home to see this, catch me, and I apologize for doing it. Am I not still responsible for making it right, or did that apology make us all squared?

Analogy would work better if you admit it wasn't your only house, made of manure and the arsonist is actually a renovator.

For the record, they're completely in their right to do this.

I just find it hilarious to see Gearbox having an issue with shady business dealings.

Gearbox is protecting its now owned ip right? Why are people mad at gearbox? Better question - why does anyone care about 3d realms? This isn't a matter of big fish little fish. There's no underdog in this lawsuit. It's pretty cut and dry.

Well, I guess I can make that Final Fantasy game I've always wanted to now since Squeenix hasn't done anything interesting with the franchise in years... :)

Why would 3D Realms even try to do this? Is makong a Duke Nukem game worth getting sued over?

go for it, but whatever you do don't call it final fantasy or the world will end. even if what you are making is more ff than modern ff.

Why on earth would you make a game and announce it knowing you had sold the rights to another company? Another company that you already tried to sue and failed.

It's almost like they want to be broken in court.
 
I hate Gearbox but anyone who thinks they're in the wrong here is completely delusional. You don't pay your hard earned money to buy the rights for shit just so someone else can use the license for free. If this were the case I'd just go make a COD game and get dat ca$h.

Wait, why is Gearbox in the wrong? I'd be pissed too if someone decided to make a game for a franchise after they sold the IP to me.


Plus, you act as if 3DRealms would actually release the damn thing.
