Serious question -- if I want a 3ds to play some single player games [Etrian, SMT, etc... basically drpgs and srpgs] would I be able to get by with a banned machine or do I need to be able to get patches? The reason I'm asking... would one of these 'banned' machines sell for cheap, and if so, does it do what I need?

Yeah exactly. And even if they had blocked eshop, it's so easy to put all the games back on there again without eshop. Really couldn't care less, especially when online play sucks so badly.
Also with how bad their prices are I've only ever bought a handful of games from eshop. This isn't like losing my PSN or XBL or Steam account.

I've been fine so far with my CFW 3DS. I use the Miiverse, friends list, and eShop features frequently.
Usually these bans happen to people who start hacking actual games, the eShop, and try cheating.
By trying to ban these devices from using online services, they're pushing people towards piracy and other things that they ironically are probably trying to fight by doing just this.
If one can't use the eShop, for example, the only other way to get 3DS games on the system is to pirate them.
I've got a modded XL and couldn't care less about being banned. I haven't played anything online in more than a year and don't really plan to. The only thing I will actually be missing if banned is a legit way to purchase FE:Fates DLC when I finally get around to playing it, and Echoes later down the line.

Lol, I got banned. Never cheated nor do I even care about piracy. Only wanted to run texture mods and retranslation patches for Bravely Default and FE Fates, and replay my favorite GBA games.
Now, I'm sad I can't play my copy of Monster Hunter online, but with that Switch announcement, I'm good.
I do find it funny how many people are butthurt about this though, when they should've known full well what they were getting into. There's a ToS for a reason.

I'm unsure if it is their choice to allow you to keep buying content off their store, or if there are legal protections for consumer hardware. Unfamiliar with the PS3/360 CFW bans in that sense. Do either MS or Sony allow the consoles to keep accessing their stores or do they ban ALL online access? If it's all, nothing stops Nintendo blocking eShop access some point down the line.

Probably even worse than Sony levels of having such shoddy foundations they cannot even support a PSN name change. However, they can ban from the eShop IIRC. I believe people playing Pokemon early got eShop bans.
Also if anyone asking about Ebay being flooded with 2nd hand banned consoles wants an indication, just look at how widespread activity is on 3dshacks on Reddit. As I'd guess due to historical Nintendo leniency, so many people were running CFW online for years without being worried.

From what I gather DLCs for Fire Emblems can only be purchased in-game. It's been similar with Atlus games I played (Persona Q and SMT4). I don't remember the additional content for them being listed in the eShop proper.

Nah, in my experience, they would console and PSN ban you. That wasn't a fun time lol.The same is true for the PS3 and the 360.
If you can run homebrew, you probably can change your console identifiers.
I have a hacked 3DS, not sure if I am banned or not I haven't even turned it on in like 2 months, still running firmware 11.2. That said, I've never actually played a single game online so doesn't really seem to be a big issue for me. I guess I let it get streetpass stuff for mario, zelda, etc but none of it ever seemed vital.
Now if my PS4 or xbox one or PC ever got banned I'd be in a world of hurt, since like 50%+ of my gaming time on TV is spent on multiplayer games online. If I ever buy a switch not sure what the mix would be, I'd definitely want some mario kart action but other stuff like mario, botw, donkey kong, etc are pretty much SP offline experiences for me.
