CDPR Facing Class-Action Lawsuit for "misrepresentation in order to receive financial benefits” [NYT]

Refund requests are pouring in by the thousands. Lawyers and investors in Warsaw are circling the situation, contemplating a class-action lawsuit against the company for potential criminal “misrepresentation in order to receive financial benefits,” according to a regulatory filing. Many gamers are swearing off playing Cyberpunk entirely until the company fixes all of the problems.

Thoughts on this? Deserved?

Also, this is a translation of the filing:
In connection with the recent events - and in particular the suspension of the sale of the CYBERPUNK 2077 product, we are currently analyzing, together with the law firm's team, the grounds for bringing a class action together with the notification of the possibility of committing a crime under Art. 286 of the Penal Code. - misrepresentation in order to obtain financial benefits.

Funny to see the dirty vultures of mainstream press covering video games only when there's drama to have.

Also funny to see investor scum wanting CD Projekt's blood when satisfying them is basically the main reason why the whole thing happened.

Not that this is going anywhere, because for such a lawsuit to have any merit, they need to prove that the "misrepresentation" has brought financial benefits, which it obviously has not. These shitty law firms do this every time there's a problematic launch and it never goes anywhere, but hey, it makes for attractive headlines for yellow journalists.

Incidentally, some of you folks with the hate boner against CDP make me wonder if I didn't accidentally click on the purple forum (which I may very well have, since this OP was copied straight from there). 🤔

i can't imagine this would go anywhere. they did not show footage and claim it was PS4/XBO gameplay.

they did not misrepresent anything to a criminal degree because they did not show any last gen console footage which was fake. case closed imo.

from what i can tell, the most they did was make statements that the game "ran well". which, it is a game that makes high end PCs struggle. they could easily argue that it ran as well as you could expect given the hardware limitations. obviously even to get it running smoother at a faster framerate, the visuals will have to take a hit. this is a game made with modern generation and PCs in mind.

at no point did they claim that last gen consoles ran as well as this gen. which seems to be the giant leap this lawsuit is claiming they are responsible for. this has no legal standing, correct? are they going to be legally punished for not making all 7 ports perform the same? that's stupid.

if they lied to investors that is another thing. but they didn't show doctored footage to the public and claim it was running on PS4. otherwise this case would have grounds. as is, it seems to be based on misasumptions and people jumping to conclusions based on hype.

I've been playing this on PC and even though the game has great ideas it falls short of its vision, many features that have been removed, and the AI....omg its horrible, I don't even know how is possible in this time and age, I mean look at games like HALO, Half Life, damn even FALLOUT AI is better than in this game....I just feel disappointed, because I love the asthetics, but in the end is just very shallow...

(...) in the event of such a glaring, fact inconsistent attitude of the management board: providing false information that the game is ready, after taking onto account several delays, as well as statements, in which the aforementioned management board admitted that they did not exercise due diligence in developing the game for the PS4 platform.

Folk are dicks. The game is buggy, so what? Every game is released with many bugs. Given the scope of this one, more are expected.

The piss poor performance on base consoles? Well that sucks, but reviews have picked up on it, so buyers are informed. If you choose to preorder a game without finding out such basic stuff, then that's on you.

Christ, I grew up with the spectrum and C16/64. Now those had buggy, poor running and unbelievably shit games. But I still had fun with them, just like a lot of people are having fun with Cyberpunk right now.

We are a bunch of entitled fuckers. It's a 50 quid purchase, that we make of our own free will, with every opportunity to research into it beforehand.

Nowadays some react like a flawed release of a game should warrant the firing squad. It has become sad and hilarious at the same time.

How would you know unless you're over there browsing and communicating with them

Communicating? No. Laughing at. Yes. They're a source of endless amusement. 😂
