this place is like talking to a wall of hate. any amount of common sense people throw at it just gets swallowed and burned. whether you continue or not with the pitchfork waving, this will get resolved.

So its common sense to ban people for daring to unexpectedly get a console shipped early, and play it as it was designed to be?

Typical M$ trying to control everything. Stuff like this is going to happen in this day and age. They need to learn how to make a positive spin on it. The guy was clearly excited to get it early and basically promoted the console for free. You don't treat your fans this way.

You don't actually know that, Microsoft has not commented on it, that is a conclusion drawn by the verge and may or may not be correct, all we know is that a video was removed for a copyright claim and his console was banned, there is no evidence of causality.

Even if there was, uploading to youtube should not be a bannable offense, he isn't breaking ToS or NDA.

If you get one 2 weeks before it's pubically available it wouldn't hurt. Not like the option of asking MS if it was ok for you to use given the situation was unavailable.
Talking about Xbox live in this respect.

So his GT is still intact and he can still poke around offline. I can totally understand a ban since Live as a service isn't supposed to be available until the 22nd. As long as they left it on launch.

I would bet money Sony would not ban a customer if the exact same thing happened with a PS4.

In 2008 I stumbled upon a store selling Killzone 2 a week early. Did I consider for even a second that I shouldn't play that game when I got it home? No. Because there is no reason I should be worried. I did nothing wrong, and nothing happened.

He isn't being punished as all he has to do is take the console back, recoup his money and any expenses involved in doing so. He'll be in exactly the same situation as if his order had been shipped when it was supposed to and he could have legitimately expected it to.

How is this not punishment? He has to waste his time because someone else fucked up?

Why are people defending such anti consumer policies?

If you are so mad at a guy for being really excited about new console and wanting to share new info with everyone that you'd support Microsoft's decision to ban his console, you are probably dead on the inside.
 
Why people continue to support Microsoft is beyond me.
Continuing to fall on their sword after banning paying customers who got your console or game early, attempting to take away those same paying customers consumer rights. Yeah I've seen less dedication to actual family members.

I don't have a problem with people wanting something I don't.

I'm not insulting anyone for buying a car, tv, music cd, film, t-shirt, jeans, etc... that I don't want to buy nor have an interest in.

I have a problem with people buying a product from a company that is actively trying to screw their costumers and whatever they place their cancerous paws (this case the videogame industry) in. Because those people do affect my hobby. They are the reason I now have to shell extra money on a game I bought to get something that is locked in the game I bought and to play a mode on the game I bought.

I couldn't care less what you do or planned to do with your money if it didn't affect me too.

But unfortunately it does affect me. So, no I don't pity idiots who get banned for something they shouldn't have been when the company that banned them is that anti-consumer cesspool that is Microsoft.

You know what you bought and you know who you're dealing with.

It does amaze me how you're not paid by microsoft seeing how disgustingly pro you are about everything they do.

People say this but they continue using stuff like Windows. If you can't stand a company, put your money where your mouth is.
Using a OS is different.

Besides most people here use windows for PC gaming. What can you do? Switch and mac and lose 98% of the games you bought on steam?

I've been reading through the Xbox Live TOS now (http://www.xbox.com/en-US/legal/livetou‎) and i cant find anything about using the console before release date. The only thing i found is this:

"We may, among other things: (i) restrict or limit access to the Services; (ii) retrieve information from the Authorized Device and any connected peripheral device used to log onto the Services as necessary to operate and protect the security of the Services, and to enforce this Agreement; and (iii) upgrade, modify, withdraw, suspend, or discontinue any functionality or feature of the Services, or any hardware or software associated with the Services or with an Authorized Device, from time to time without notice. We may do so by the automatic download of related software directly to your Authorized Device, including software that prevents you from accessing the Services, playing pirated games, or using unauthorized hardware peripheral devices."

It is very general/vague though.

If Microsoft could just flip a switch and turn xbl of until the 22 would that be a problem? He may have received his console early and good for him, but nobody said Microsoft has to provide him access to xbl until the 22.

But they can't just turn off live because presumably there are preview consoles out there that should be allowed to connect. If only they had a way letting some consoles connect while preventing others.. wait that's exactly what they did.

If he's still banned in the 22 then I'll think something is wrong.

MS launching a copyright claim on YouTube against the guy after banning his console is adding insult to injury, not providing justification!

Claiming copyright on the youtube content is one thing. I don't think that is why they could ban his account, though. He didn't sign any NDAs and he used hardware that he rightfully purchased.
A consumer who doesn't pay attention to launch details could simply guess that they have moved the launch day since he received his console early.
I hope it's a temporary ban until the 22nd. Anything else would be extremely stupid.
