So Target shipped someone an Xbox One already? [Update: console-banned until launch]

Amazing at Microsoft managing to turn potential good PR to bad PR.

Also amazing are some of the idiots defending Microsoft. Sure they're allowed to ban everyone using Xbox Live if they want to. That doesn't make what they did right or something that should be defended by any consumer.

From that list he showed of the games, looks like there are hundreds of people online playing games not getting banned.

If a MS employee did the same thing with his X1 at home, guess what? He would get banned and fired.

Trust me I get what ya'll are saying. Anyone who knows my post history knows I have no love for MS lol. But acting all shocked the dude got banned for going on a twitter rampage with his new console is beyond naive. If someone got a PS4 early, posted all kinds of crap up on twitter and youtube, guess what he would likely get banned too.

NO it doesn't....he didn't sign any forms, he didn't agree to not post footage of an item he bought and paid for online. He's not a fucking paid off journalist, who had to sign top secret NDA agreements with the cooperations before opening the system. It was his to do what he wanted with it, and no fucking street date should stop him from doing what he wants with something he legally purchased, and was sent to him early by mistake.

God...this is bull shit that anyone is finding a reason that this is okay.
Agreed. And what's more, the "copyright infringement" seems like some far-reaching, invasive censorship and which has potentially cost him thousands of dollars in lost earnings.

i'd laugh if the reason youtube is going to be copyright infringed for xbox one by ms is twitch deal

laugh so hard

but seriously, this comes down to when do we own a product and what rights do we have. If we don't have the rights to film something we own and show it to the world, then the law has gone WAAAAAAAAAAAAAAY to far in the direction of corporations

Fair use people, fair.use

guys what if... and this may not be crazy (given its a weekend as well)

What if current Live thinks that the Xbox One is a modified console (which is why consoles get banned in the first place)

so you connect in and don't have a special gamer tag (that the media get for reviews etc) so connects to OG Live lets say, it reads the hardware, and says nope thats no 360.

Now, this is potentially a bit nuts, but i imagine this entire system is automated. If it is, then it would read the hardware for differences to a 360 (and a One come 22/11 or even now perhaps) and ban appropriately.

Not defending the actions, just putting it out there.

This close to launch, a lot of MS staff and others are playing online. They'd all be banned if it was automated.

So, does Microsoft expect people who accidentally got their Xbox One's early to just sit and twiddle their thumbs until the 22nd?
Or do they just not want Youtube video's of their console out?

no shit. they are under nda and employment agreement

the analogy is a failure

I hope anyone buying the Xbox One understands what sort of company they're supporting by doing so. This is just disgraceful, I think the worst bit is a copyright claim against the unboxing video. That's such a crock of shit it makes me want the console to fail heavily.

Company is fine. Kids these days break rules thinking it's cool. This punishment is justice porn imo.

It's the same thing for both consoles. When you put in the disc, you have to wait for the first "chunk" of data to install. Once that's installed you can launch the game and start playing and the system will continue to install the rest of the game in the background.

BTW both Sony and Microsoft have a limit to the size of the initial "chunk" of data so it will never get out of hand. The "You can start playing at 50%" part is also not set in stone. I mean, depending on the full game's size the fist chunk might equal 50% (like we've seen in this thread) but it might equal 25% or 30% or whatever. So don't get hung up on the exact % number, this will change from game to game.

I thought that was for download titles only on ps4. Disc games install while you play.

INCORRECT.

Microsoft bans for 2 reasons

1) pirated games

2) modified consoles

pirated games they do based on the street date of a game. I have had to give Microsoft my gamertag numerous times when i've had early software for previews etc.

Forza Horizon. I had the game a week before general release and my gamertag was listed as 'green' hence i wasn't banned for playing it online early. This is very common for people.

The same would be with Xbox One right now with media and staff. All gamertags would be green listed.

so yes, its automated

Both happens? You can play while you install, you can play while you download.

But of course Cerny exaggerated in the beginning saying you just had to download " bits of data " before you could begin playing, but it is more like a percentage. Dunno if they ever said exactly how much data of a game needs to be downloaded before you can begin playing, but I would guess like 25% or something. Who knows.

I cannot believe there are people ITT defending MS for this, the guy bought a $500 console and now it's banned because he had the audacity to play it when it arrived at his house after legally purchasing it.

What's wrong with some of you?

Welcome to fanboy land. These peeps are used as case studies in college.

As far as I know you can play instantly on PS4 when you insert a disc and it installs in the backgroud for smoother loading.

I am guessing the wait 25 minutes to play any game on Xbox One is CBoat's final ass storm.

If this console comes with any type of brochure suggesting he could get to xbox live I hope he sues the shit out of microsoft.

Its not this guys responsibility to keep up with street dates.

I've seen this term anti-consumer thrown so much around here...do you know what it means?

if ms is anti-consumer, they wouldn't be selling this shit at all to anyone. I think you guys need a better term to use like anti-neogaf or anti-entitlement.

Congratulations. I was sent here from NeoGAF's worst posts on Twitter.

HMMMM

I wonder if this is anything to do why Sessler thinks his career is in jeopardy and he has to pursue other things (or consider it).

a Twitch deal makes sense, no youtube apps are available on launch on both platforms.

Problem is, people are finding ways to get their material to youtube, if thats the case, a shit storm is incoming...

PS, this is still wrong to ban him for terms he is not aware off.... he has done nothing wrong, extremely bad PR from MS part again

Why are people surprised? MS have been perma-banning people for minor stuff all generation long. I have no sympathy to be honest. If Amazon shipped my PS4 early, I'd honest to god not touch it until the 29th. I really do mean that, spending £380 on a console is enough of an incentive to not risk getting banned for using it early.

I honestly wouldn't either if it was ps4/nintendo/microsoft I wouldn't upload anything because I know how these companies react, I'd just play it on the low and maybe give pictures without exposing my account or something

So, until the actual launch day, everyone that gets an XBox One early needs to be white listed to poke around the UI or risk a ban?

Yeah man, if MS was anti consumer they wouldn't have a business maiiine, you deed it.

He can't sue MS because he can recover his money and expenses from Target, should he not opt to just get a new console at the date of promised delivery. Brochures are irrelevant because he could not have reasonably expected the product to be delivered before the agreed date of delivery, in particular in the context of a new product launch.

And what rules would these be? Where does Microsoft say you're not allowed to play an Xbone before the launch date? Street dates are rules for retailers, not consumers.

pretty much i would think unless MS stops the auto bans

but thats how they do it on 360 and that will be how it works on the One.

If you play a unreleased game on 360 well before the street date or in some cases 2 days before, it gets your console banne dbecause they think its pirated

Damn, a lot happened since I went to sleep!

Dude got banned? Man, that fuckin blows. I hope it was just a knee jerk reaction from MS, and that they straighten this shit out once they actually look into what happened, because they do not look good right now.

Nice use of "the other companies do it too" defense. Do you have specific instances from Sony and Nintendo?

I hate to be that guy considering at some point I will actually buy an XB1... but when have Microsoft ever looked good this year? it's just one colossal fuck up after another PR wise.

If this guy isn't unbanned by the 15th I'm sure he will have a pretty solid case against them.

Exactly, if the dude would of just played it cool and just used the console like a normal person, he would of been fine.

But nah he is all over twitter, ( did he make a new name too? ) bragging about his new shiny console, showing the UI, telling all about the system, making youtube videos, etc. etc.

He is still using his system right now if not for that.

Sony would do the same thing, Nintendo would do the same thing, Apple would do the same thing, Samsung would do the same thing, etc. etc.

That is why when video is leaked of a smartphone early or something it is always " anonymous ". The dude leaking footage doesn't plaster his name, twitter handle, youtube name, etc. etc. on social media for the company to see.

He f'ed up himself. MS may have used the Youtube video as the " official ( legal )" reason as to why it was banned, but I am sure it was the twitter account that really got him banned, because most of what he was telling was stuff unreleased before then that MS was likely saving for PR drips the next few weeks. Now the secrets are out, and it won't surprise many people.

I'm angry for having to come in and even attempt to defend MS in any way lol. But it was obvious from the jump the guy was pretty much begging to get himself banned.

When he posted his gamertag how many " and here we go " posts occured soon after? People knew what was coming even then, when he was exposed.

Nice to see that filming a legally purchased product being unboxed is somehow copyright infringement. How people defend that BS is beyond me but defending him getting his console banned? Ridiculous.

Thanks MS. I said that I would probably get a cheaper, Kinect less console eventually. Not any more. Even at your worst I still assumed that I could at least own the hardware and packaging if not the games. Guess that was naive of me.

They finally started to look good to me after watching that 12 minute dash demo. I was really impressed.

I don't know I can't really remember a situation where someone got the console early and did not get their parents in trouble for it - or acquired it by retailer early and showed the UI & other neat stuff so who knows im just saying I wouldn't really risk it, it sucks for that guy though lol.

man, how did they turn the best PR i've seen for the xbone into such a shit show. target sent him his legally bought console early, he plays it and gets banned. that's fucked up.

I have no words for this situation. Why are they so anal about breaking street dates?

For starters there is already a small frenzy over the pause and play features apparently only being able to last 20 minutes. So of course now Microsoft has to come out and explain if that's true but the negative damage is already in motion. It also questions why the system is out so early and why MS could not have beaten Sony out for the release date, or at the very least at the same time.

Two things pop out to me, one is why did they release the update so early that enabled his system to be active? Two is why would he want to connect his system online knowing full well it's a risky move? If it was attention he wanted well he got it.
