I got around this on the Wii U with this one simple trick that Nintendo hates:
I didn't pay the upgrade fee or buy any new VC games.

I am actually okay with an upgrade fee as long as it is confirmed to be the last one. Hoping that with this generation having a new infrastructure, and architecture as well as the new mynintendo and Nintendo account, we won't have to do this ever again with them.
I am going to wait for that confirmation. I stopped buying digital stuff from Nintendo almost a year ago because I want to know the plan moving forward.
TBF, developing an emulator isn't easy. That investment has to be justified somehow.So rebuy games you already own all over again... at a discount.

Not that the upgrade fee isn't bullshit, but let's not pretend that VC is something it's not. My physical copy of Mario 64 does not necessarily entitle me to a Switch copy. The reason it's bullshit is because they can actually just do it for free if they chose to.
My Nintendo ID is on my Wii U. Why am I going to be asked for an upgrade fee, again?
Not to mention that this will be the worst playing VC system due to the lack of a d-pad.

But you're upgrading it to include features not previously had on a different system. That's why it's a small upgrade fee and not you rebuying it

Of course it doesn't. But with VC, it was supposed to. With online account, it was supposed to. It's not about entitlement but more like about policies. It's just so annoying to see Nintendo keeping this freakin greedy policy for everything. They just keep cutting every corners for a few dollars rather than banking on customer loyalty. These VC games have made their money back decades ago. It wont kill them to allow to upgrade your VC games for free. It'll actually make people want to spend their dollars on OTHER vc titles.

I didn't paid a single cent when SEGA upgraded my whole Megadrive library with support for romhacks, workshop and a new frontend.
All your digital Wii U/3DS purchases are tied to your NNID or Nintendo Account (both I think), so it will be very easy to determine what you have purchased.

Hence the "nearly everyone". But they did for Vita. Microsoft did for BC titles. A lot of publishers did for Remasters on Steam. SEGA did for their Megadrive/Genesis collection. Android and iOS did for all the apps when they upgraded the OS.
Your counter exemple is ONE bad practice which doesn't justify another one. That kind of thinking is just lowering the bar.

Publishers aren't paying for the hosting costs on steam or google play afaik.

correct me if I'm wrong but isn't the majority of digital content on PS3 locked to that generation of hardware? how much of it could you actually bring forward to PS4?
I'd be willing to pay exactly $0 to play digital titles that I've already purchased...especially if I had already paid and upgrade fee on Wii U.
This shit is why piracy exists and honestly, it's more convenient to just buy a physical copy of most games, rip the image, and play on an emulator.

Also pleeeease. Don't make it like they broke the bank by making a new NES emulator which they made their money back already with NES Mini. The developpement of new emulator is justified to sell VC titles to new consumers. Not for the people who already bought these VC titles.
Sorry but your view just sound like REALLY forgiving when it comes to Nintendo's practices. Nothing warrant the upgrade fee when nearly everyone else make it for free.
They should probably have a second option to transfer all your vc library for a fixed price, like $10 or something. It'd be a good way to reward people who have already spent large sums on vc in the past.$1-2 per game doesn't sound like much unless you have a bunch of VC games.

A lot of indies were cross buy for PS3-VITA-PS4. Sony PS1 classics were playable across PS3-PSP-VITA just not PS4.
Some are cross-buy with PS3-PS4 just not the PS2 and ps1 classics to my knowledge.
People saying "It costs Nintendo to develop new emulators for the new systems, so the upgrade fee is reasonable" have a remarkably narrow-minded view of business with regards to consumer psychology.
Nintendo doing a bad job of this stuff makes customers far less likely to spend money on VC (and other) stuff from Nintendo.
If they are able to say "You can buy [Game] for $[Price], and it will work on all our devices going forward" people will be more likely to open their wallets, because it's of increased value.
I'd have spent more on VC across their previous devices if I'd known that they'd transfer forwards at no additional charge.
Hell, if VC games on 3DS included a Wii U version (and cross device cloud saves) at no extra charge, I'd have bought a lot more.
Hopefully this will be the last time they have VC purchases arbitrarily segregated, but it really would be absurd not to transfer purchases forward.

I'm not sure Nintendo is breaking the bank when you can hold the entire NES library in half a gigabyte. Then again, they make that money back on selling it to new customers. Then again, Sony did it for Vita and PSX. It's not because Sony decided to become greedy that it makes it okay for Nintendo to be.

It's not greed if you only charge the break even price. Wiiu was greed as it was defo more then break even. But there is inherently costs in doing this, and the costs will increase each generation.
