So, what are your plans on your next place? You better not say you are living with any of your relatives or else I might cry.
 
If you don't mind sharing, what's going to happen to the rest of your family once you sell off the house? Congrats BTW. You deserve it.

Okay.

No bullshit this time.

The last offer we got was shit, but we got a new offer that was waaaay better than the one that flaked out.

They signed escrow, they deposited money into the escrow already and I just finished going though all the rooms and the house with the buyer, the realtor and the contract inspector.

They all loved it, they all agreed it has some issues but the buyer is dead set on buying this house no matter the issues. He WANTS to fix the house where I left off.

So I just got a call from the escrow company about a $6000 lean on the house by some lawyer trying to get money from my deceased aunt.

They're gonna be sending me more info about it next week. Wonderful.

They have to clear the title to sell it, so one way or another they're going to have to have that lien removed.

No, since the only reason we found out about this lien is because none of the other offers we had ever made it so far as to go into escrow with us this far.

The ones that backed out signed our offers and but backed out before going any further.

He cancelled. His relatives talked him into pushing for a more "modern" home and he was forced to back out or lose half of his money.

Fucking christ.

At least I got three free termite reports and a full free professional inspection out of it.

I've missed three job interviews because of all the preparations i've been making getting everything done for the buyer, and it didnt even matter.

Im going to lose this house with nothing to show for it.
 
Damn man, if it's not one thing it's another. I would have thought a title report/issue would have come up a lot sooner in this process but I guess it just depends when the previous buyers walked. The easiest thing to do would be to take out an unsecured loan and take care of the lien, then pay the loan off with the proceeds of the sale. But if someone walks again then you're on the hook for payments. Have you been in contact with Wachovia? If the debt (lien) is that old then chances are it has probably been sold to a collector and you might get it cleared for a fraction of what's owed. You need to get that lien cleared asap and then hope you don't come across any more flaky buyers.

And did you make any progress with the loan modification so that the foreclosure is delayed? It's been about six months since we talked so hopefully they gave you some breathing room at the very least given the circumstances. Keep plugging away...
 
How is there no penalty for signing papers and then backing out. What is the point of signing if you are not committing to anything? There's got to be some kind of system in place to prevent all of this inane pussyfooting.

Shit man, you are a hero for stomaching through all this. I truly hope I open this thread one day with you updating us from a resort on a much deserved vacation.

Free inspection is nice. And you should have that escrow money now too, right?

Selling a house isn't easy. Good luck with getting the title cleared up. I had to go through some problems with that as well and it was a bit of a headache.

Nothing you can do about that lien except pay it off. No way to sell the house with that on record.


The Lien was never the issue, since it's only us that deals with it. The issue was his family was worried about all the fixes to the house he would need to do because of the inspection report.

However the inspection was a double edged sword since legally they have to inspect everything by the current codes it states in very big letters at the beginning of the report

This home is older than 50 years and the home inspector considers this while inspecting. It is common to have areas that no
longer comply with current code. This is not a new home and this home cannot be expected to meet current code standards.

I was talking with the owner directly about the inspection report, he cleared everything with me and we did a walkthrough about all the fixes and problems it outlined and he was very enthusiastic about getting to fix them. However he made the mistake of showing it to his relatives and they didnt agree.

Thanks again woodwerd for the help you gave me before, Ive been communicating with Ocwen, they're being somewhat lenient with me although to keep requesting loan modification packages that I know is only going to get shot down is very annoying.

I have a prospective buyer coming today who I decided to give the home inspection report before seeing the house to guage his reaction, He was an earlier offer we had at a lower price but we managed to bring up his initial offer quite a bit after the last guy cancelled and showing him the inspection report.

So we'll see how it goes today, it's a little lower than what I was hoping for but at least it's a way out.


EDIT: And just as I prepare to clean the house, I notice that there's a big ass leak in the living room ceiling from the rain. I go up to check on the balcony, knowing that I had hotmopped the roof and layed out tar paper because I know it was going to rain hard and I see that my brother had ripped out the tar paper and thrown dirt on the balcony floor to plant his weed plants, Now I am cleaning out dirt and a couple of gallons of water from the balcony to prevent it from flooding in the rain.

The only possible way for me to get rid of them now, would be to buy the house myself so that I have full authority.

But I've been fighting the mortgage company since the beginning to place the loan in my name, as was going to court so I can legally assume the loan as well as the title.

However since the mortgage company refuses to acknowledge me because the original loaner is deceased and I have no way to resurrect the dead, I am left with very little options.

So basically since im the "estate" of the deceased not even written letters from the court specifically stating that I have full athourity to negotiate their property and anything relating to the "estate" the loan company refuses to work with me because I am not the original person who opened the loan.
 
You are an awesome person! Great job with the renovations and keep going. Have had similar situations to the point where I would just sleep in the car the house was so dirty. Feels good to break out of those situations

How do you know your mom wont screw you out of the money? She was taking your brothers side before. What if he says something to her of how you all deserve it? Then what? Left with 1/3 or less of her half....
 
This house and your relatives are going to kill you. I'm not being overdramatic: I'm genuinely concerned. Both your uncle and brother are violent and dangerous, your own mother doesn't seem to do much, and all your efforts to sell the house are wasted by your relatives. I guess you need money to move out, but at this point I really think that it would be healthier (both physically and mentally) for you to just leave and forget about this house and its people. I kinda fear that despite all the time you invested in renovating it you will never be able to get rid of it, and the longer you are caught in this sick environment the longer you will remain jobless (since you mentioned that you missed several job interviews because of all the events surrounding the house).
But, well, I guess that if you had the money, you would have move out a long time ago... I really feel for you :s
