OP, your Uncle and Brother both have psychological problems. Pissing on the floor is not normal, violent outbursts and physical violence is not normal. Your mother has Stockholm syndrome, and you are in denial.

Sell the house, take your mom, and get the fuck away from both of them. It sounds like your uncle has dementia, and god knows what is wrong with your brother. Does your family have a history of mental illness? Pot, PCP, and to a lesser extent, alcohol all exasperate symptoms.
 
I don't think you're adding anything to this thread, with this post or any of your follow-ups. Unnecessarily, ignorantly and incorrectly critical towards a guy who is nothing short of remarkable.

Your newest posts, OP, sound like great news. Sell up and move out ASAP, don't look back. I would start looking for a new place to live ASAP, too. Dont wait for the court business to be cleared up, or youll be waiting forever. You sound anxious, but never doubt your ability to remake your life, OP, you are clearly a cut above most people in determination and spirit.
 
This is by far the most crazy situation I have ever read on the internet. I've spent the past hour or so reading this entire thread. I don't really know what to say besides good luck with the appraisal, and that you are a better person than I ever could be.

Also, I have a really shitty uncle too. (But nothing near the level of yours) He's homeless and lives off social security disabilities since he thinks that he can't do anything with his life because of his bipolar. He used to live in my grandparent's house (doing nothing but drugs), but after they both died from a long and stressful 8 years of Alzheimer's my mom kicked my uncle out and sold their house. Because of how my mom handled my uncle, all of my other aunts and uncles hate us. Now I don't really have any family besides my parents and my brother. My mom constantly stresses out about him since he moves to a new place every few months. He's even asked to live with us. He's been homeless for the past 7 years.

I could easily see my uncle becoming something similar to yours by now had she let him stay in our home, but my mom refused to let him live with us because she's not as empathetic lol.
 
Well it's been awhile since I updated this thread.

It seems a shame to sell or lose the house because of the mortgage loan against it. Everyone keeps telling me that losing this house for only $150,000 loan is more than ludicrous.

But I cant get the loan company to work with me, they've been stalling and jerking me around for the past six months now and I've yet to see them co-operate with me in the slightest.

There is no way I can pay the $20K in back/late payments that I've missed since I filled for a loan modification, and I'm pretty sure they're throwing my house on the auction block within the next 30 days.

I need some advice on what I could do next? I would keep the house if I could, but I've learned that selling it now would be less than profitable for me with the loan against it coupled with the late payments and interest owed.
 
Is the bank doing something the contract says they shouldn't? Did they do anything else wrong? You might want to try contacting Legal Aid in your area. You might be too well off for them to represent you, but they might be able to point you in the right direction.
 
I help people with foreclosure prevention options for a living. Compare the property value to the debt owed and ask yourself whether it's a hole that you can ever see yourself getting out of. I've been able to help a lot of people but some of them cannot bring themselves to realize that their home will never be worth anywhere near the balance owed. I followed this thread when it was active but forgot a lot of the details...I imagine you're getting stuck in the loan mod paperwork loop due to the joint ownership issue. PM me and I'd be happy to help as much as I can.

It's not the bank, it's a company that buys loans and debts. They go by the name of OCWEN. I've never heard about until GMAC went under and sold our loan out from under us to OCWEN and dealing with them is just an utter pain in the ass. Everytime I call them to talk to them about and issue I have to spend an hour just explaining to the rep who I am and why I am authorized to talk to them. I have never once spoken to a native english speaker either, I'm always transferred to reps in a call center in india whenever I need to work out some paperwork issue, dealing with them has been nothing but trivial.

All the legal advice I was told was that this is typical of loan companies to try and stagger you as much and as long as possible to just try and snatch the home from under you. I've given everything they've asked for and more and yet they refuse to work with me because "The original loan was signed under a person that is now deceased" NO FUCKING SHIT! I've given them the death certificate and my court signed document detailing me the executor of her estate and they're giving me this bullshit just to stall me.

OCWEN is a mortgage servicer based out of Sacramento. They handle the day to day crap for the trustee/investor behind the loan. I cannot put my company's dealings out there, but I have a very good idea of what you're going through right now. If what you're saying is true and the original signer of the mortgage is deceased, you may very well be out of luck in terms of a mod. Unless there was a trust set up for you or whoever is requesting the loan mod prior to the death of the original borrower, it may not be possible to modify the loan. I run into this a lot. Like I said, I'd be happy to talk to you more.

A lot of people like to think it's stall tactics and big bad banks at work, but people don't realize that servicers are just a middle man between the borrower and investor. I'm not defending them in the least, just trying to point out a common misconception.

You need to take an impersonal view as to whether this is a smart move for you. Consult a pro (aka tax/real estate attorney), but I realize money is tight. If you think the property value will - now or eventually - exceed the debt owed by a considerable amount, then yes, this may be worth it.

The bottom line for loan mods comes down to whether the investor will make more money foreclosing on or modifying the loan. It's not that simple of course, but it's their bottom line that dictates things. If you have the ability to repay the debt and the numbers make sense for them, then you have a fighting chance.

Well I got off the phone with them and basically they've denied me on all sides.

The investor denied me, and the HAMP denied me because the original borrower is deceased.

I dont know how filing for bankruptcy could help my case since It would be me filing for bankruptcy and not the deceased, since her name is still as the borrower would that affect it?

if it did would that erase the $20K debt? or is it just a temporary situation?
 
This is quite a thread.

Word of advice to people who are dealing with something similar or whenever they do.

If you are in charge of a house and you have part ownership, and you have insane behavior from people. It is in your every interest to take action against anyone and everyone who is destroying your house. You are paying the mortgage and its your money getting sunk in.

If the insane person is not an owner, evict them immediately. The sheriff can serve the eviction easily. (In this case, I would have evicted the brother)

If the insane person is an owner, you need to gather as much evidence to get them institutionalized or in a care home (for those insane elderly relatives). If you can show police video evidence of any misdemeanors they commit or damaging the property, your case becomes stronger every time. Get police reports and as much video as possible. Build your case against them. You need to get acquainted with the authorities on a first name basis. Build a relationship there, get them on your side. Once they have lost their freedom or declared insane, you can move forward with your ownership issues. (I actually had my grandpa declared insane and was a danger to himself solely on video evidence of yelling at me drunk and falling down the stairs and injuring himself needing medical attention and unable to identify himself at the hospital)

This may seem like a complete no brainer, but lots of people never thought about leaving absolutely no accessible food to lunatics who are squatting in the house. Not a single bit of food, utensils, cups, or plates. It is unlikely they can acquire such basic things on their own. Don't make it easy to live there. (Had to do this with a deadbeat uncle who was leeching while I was dealing with grandpa)

Again, these situations are difficult to deal with, but you gotta come into them with a game plan, guys.

I'd like to thank WoodWerd for his advice, and help and I've realized that it's best to move on rather than waste my life fighting for something that will only give me grief. His advice helped to make the best decision.

Wow, it's amazing what you did to the house! Besides your uncle's room and the piss-caked kitchen wall it looks like a place I wouldn't mind spending some time.

Your uncle sounds mentally unstable, perhaps due to long-term alcohol addiction and the damage his body has accumulated over the years. Hearing the severity of his problems I can't help but ponder how long he has left in this world.

Man, selling a house is exhausting.

I have had nonstop flood of showings scheduled nearly back to back all day long of people coming in and out of my house. I've been cleaning and shining everything like a motherfucker.

Although I'm going to have to ask my realtor to screen some of my showings because the last guy ended the showing by trying to interest me in some ACN Donald trump sponsored pyramid scheme, I actually had to threaten the guy that I was going to call the cops before he left my house, mother fucker wouldn't shut the fuck up about de-regulating energy costs.

But the flood of appointments is a good thing, everybody seems really enthusiastic on walkthroughs and they're always interested in seeing the giant creepy old basement whenever it's brought up.

I have high hopes that we could have a buyer within the next month or so.
 
The uncle here has to be mentally ill. I know you say he's not and he's a smart guy, but you might as well consider that severe form of alcoholism a mental illness at this point. People can be very intelligent and mentally ill. I know alcoholics and they don't do anything like this. Anyone living in their own urine, feces and allow maggots and ants to walk around and over them and the one's they love definitely need psychological help.

Of course, you care. It's family but there's always a line and this would be crossing it. You need to tell him again, "get help!" or else. You need to take plenty of pictures. There's a point of absurdity and it has been long crossed here.

It's barely been a week and we're getting offers, the realtor is very excited.

The offer is pretty good but the realtor said to wait it out for more offers in order to mimic something like an auction sale.

Are the offers coming in higher than the debt? Hopefully you get something for all you've put into it.

The debt is only $180k, the house is worth more than $550K compared to the $340k it was before I fixed it up.

Signed the papers today for a very good offer.

Also thanks to WoodWERD and following his advice I actually somehow managed to get the Obama Keep your home administration to re-open my case. So either way by this week I'll have confirmation on them re-structuring the loan or selling my house.

I think even if they do accept to re-modify the loan I'll decline because I already settled on selling and the offer is very good and I dont want to lose it.

I cant live here or with these people anymore, after being diagnosed with Type 2 diabetes and then actively improving my physical health for the past four months I feel more confident in myself, I'm getting the fuck away from these people and starting my life over. I dont want to end up like them in another 10 years.
