I have to say I'm surprised that top-level "premier" posters like me weren't outreached to in advance, or at least given the ability to sign an agreement with more flexibility. But then again that is the direction NeoGAF has been moving in for years now, so I can't say I'm all that surprised....

Well I guess my point is that it's a bit ridiculous that at least long-time posters weren't able to negotiate these agreements individually. If a group of people were, then that supports my argument even more. Definitely some sort of "pay for play" program would have been very interesting and potentially led to even better content.

Seems to me like this would have been a considerably smaller issue if Evilore made a thread going "Guess what bitches" and posted about the ToS change himself and expanded a little on what it meant rather than people tripping on that shit on the Kotaku thread, cause honestly? Non-issue.

I would think that the same as what happens with images is applied. It's not hosted on GAF server only the url to its link, so no problem. But I honestly don't know.

This thread was posted just about simultaneously with the change, and there was an issue in progress blowing up the gaming forum that needed to be addressed with a ToS update ASAP. It's not like the change was supposed to go unnoticed. I just didn't have an opportunity to issue a statement since it was picked up on instantly.

I'm fine with how the thread turned out, as it seems we have dozens of IP lawyers that spring into action when this happens to explain what the hell is going on better than I could ;b

Yeah, I think most people realize it's not really a big deal and is quite common. Still a few "the sky is falling!" people around, but you could announce "water is wet" and people would be up in arms.

Excellent move, updating the TOS. What a good idea that was! :)

I could see a legit concern if you were someone heavily involved in the creative writing threads, or something. But I think for most posters, me included, can't say I give two thoughts to any of my awful pun-filled posts over the years.

Whoa whoa, I'm not an IP lawyer, I'm just the lowly clerk. Since I don't have a background in it, I have to constantly read, look up cases, ask questions, and have shit explained to me. Doesn't mean I don't learn fast.

I'm not going to answer everything here since it's awkward on my ipad.

1. I'm in Canada. You don't NEED to have it officially copyrighted, but you can for extra protection. It's automatic otherwise (we had to do one recently and I had one of the lawyers explain to me why).
2. The TOS doesn't transfer ownership to Evilore no matter what it says. 1 I didn't give expressed consent to these new TOS. 2 Ownership will come up in a lawsuit and I simply don't see how a website's (even one as glorious as NeoGAF's) TOS can hold up in a civil suit, which is an extreme example.

Additionally, this doesn't cover people posting others' work on here. If I post...say...an up and coming artist's
photo, sure doesn't give NeoGAF the ownership of it.

Edit: I dunno...lawblob. Copyright is granted as soon as it's published. I'd strongly advise the owners to not test the boundaries by selling those stories. If nothing than to avoid the cost of hiring a lawyer (god damn you guys make a lot) to battle in court with a Gaffer...who may have a lot of money to keep their lawyer on the case.

I still say you guys are over-reacting. :p

Yup, that's a legit worry, and I thought about a way to add language to exclude those folks. It'd be an easy fix, but I don't think Evil's gonna change the TOS yet again :)

My question is who reads the TOS and more importantly who was reading it regularly and closely enough to notice the change?

Seriously though, if any of the crap I type out on here is worth a cent feel free to sell it.

In regards to posting images, you're already doing that, but surrounding it with tags, which the forum software takes as "welp, better follow that link and show everyone what is there!". What GAF has rights to is whatever is written and saved onto their servers. By posting images, you've given GAF a non-exclusive license to THE URL of that image, but not what that URL links to. The image is still wherever you put it, and therefore the property of whoever's server it is on. So say your post is

No image there! They have a right to the URL, but not the URL's contents. Therefore, your art is safe. Literary works, on the other hand, ARE saved on the servers, since it's text, so that you may want to simply link to if you're concerned.

And if it hasn't been drilled into your head already, without this addition, you can sue GAF for something so stupid as "distributing" your artwork to some poster you don't like, since that's how the internet and forum software works, it's distributing your post (art) to someone else, in this case, someone looking at the site.

I'd probably save my shit flipping for when you investigate your image sharing site of choice's TOS. Because they own your actual images.

Me? Nothing but banter as usual. I'm just saying I'd think PM investigation should be left to admins & mods. PM = private message after all. I just think if anything sour(or severe) goes down the info shared shouldn't be made public.

Site staff doesn't have access to your PMs.

It's there to cover things like receiving PMs, or PMs being forwarded and then posted openly, etc.

This doesn't really have anything to do with GAF or EviLore's reasons for doing it, but it's just interesting because it highlighted Reddit's user agreement clause similar to the new GAF one.

A user posted an idea for a movie as a comment, it blew up, Warner Bros bought the exclusive rights to make a movie of it, and now there are debates as to whether or not it was the user's rights to give.

So just be careful about posting your ideas in a public forum like GAF or reddit.

On a side note, EviLore, can you put in functionality for users to sticky threads (for their personal view)? For example, I'm following the Windows Phone 7 thread and would like for it to appear at the top of the list, but subscriptions don't really do that

Most ToS included something similar, but it is always in your best nature to put a heads up about it.

If he just made a sticky before it happened, said it changed, and exactly like he did here. Explained how nothing really has changed, just saying it allows for other feeds to repost it. It would have went over 1000x better. That's it.

Personal stickies? Hrm, someone would probably have to make a browser script for that, as it seems like a niche function.
