Nintendo found guilty for infringing glasses-free 3D patent

In developing its 3DS portable console, Nintendo infringed on a glasses-free 3D patent owned by a former Sony employee. That's according to a New York federal jury, which earlier today hit Nintendo with $30.2 million in damages. The patent in question — granted in 2008 — pertains to viewing 3D content without a need for specialized glasses, which is a major selling point of the 3DS. Seijiro Tomita (who spent 30 years at Sony according to the court complaint) sued Nintendo in 2011 for infringing on his invention, claiming that he'd met with the gaming manufacturer in 2003 to discuss the technology. In its defense, Nintendo's attorney argued that Tomita was just one of several 3D purveyors it was in contact with at the time and that the 3D implementation in the portable device avoided key aspects of his patent.

Ultimately the jury sided with Tomita and awarded him the compensatory damages. $30.2 million isn't exactly going to bankrupt Nintendo, and the case is unlikely to have any long-term consequences, but it's still an embarrassing legal defeat for the gaming industry giant.

A spokesperson for Nintendo of America offered the followed statement to Polygon.
A jury awarded $30.2 million in damages to Tomita Technologies in a patent infringement lawsuit brought by Tomita against Nintendo. The Tomita patent did not relate to the 3D games playable on the Nintendo 3DS. The trial was held in U.S. District Court in New York before Judge Jed Rakoff.

Nintendo is confident that the result will be set aside. The jury's verdict will not impact Nintendo's continued sales in the United States of its highly acclaimed line of video game hardware, software and accessories, including the Nintendo 3DS. Nintendo has a long history of developing innovative products while respecting the intellectual property rights of others.

OT: Wouldn't be the first Law suit Nintendo lost, for once it wasn't an angry parent though.

Patent troll?? The guy patented technology that allows glasses free 3D, I think he deserves some money. No sympathy for large corporations.

I don't understand this. Nintendo was shopping around for glasses free 3D, went to various developers, ended up buying from Sharp. Shouldn't Sharp be at fault rather than Nintendo if it's true that there was patent infringing at all? Or did Nintendo then provide Sharp with the design they needed built which means that it's their own fault? Or did they buy the patent from Sharp and now everything about it is their responsibility? Or maybe they could sue Sharp for having sold them something that was infringing on someone else's patent (assuming they wanted to pursue this considering it could harm their relationships when they still need them for manufacturing)? This is too complicated for me I guess. Either way, hopefully this is the right thing, not some clueless and ignorant judges and jury sticking it to the man while in a hurry to get home. And if that's the case, hopefully they will appeal and win. Lol @ some people acting like Sony are involved and won some grand battle against Eviltendo.

Hope it's now time to release new colors/editions of the 3DS XL for Reggie, you need to compensate for this loss.
 
He's a troll in that Nintendo did not create the technology being used. Sharp did. If there was a violation of patents it is on Sharps end.

That's not what the court ruled. They ruled Nintendo specifically violated his patent, not Sharp's.

It's mentioned in the article that a defense of Nintendo's was that many people have 3d patents, but that wasn't good enough for the court.

So, this guy did not violate any one's patent. Nintendo violated his.

LOL at people calling troll/patent abuse. This is the exact situation patents were made to protect. The little guy goes patents his work and goes to the big guy "buy/license my work", the big guy just steals his idea and doesn't pay him for it.

No kidding, people patent everything these days. Any idea you come up with, someone will claim infringes on their patent. It's dumb.
 
Yeah, I also thought it was Sharp. Didn't Nintendo also have plans to put 3D screens on the GameCube and GBASP? Those would have been Sharp, too, presumably using a technology similar to the 3DS screen, and developed before they met with this guy.
