Sony Updates PS4 "Software Usage Terms"

I don't think they plan on enforcing it, but the fact it is even there is appalling. It's one thing to say outright that you are going for a steamworks-esque system and another to say you are not and then secretly push the terms just before the console launches.

"6.2. You must not use Software commercially, broadcast it, charge for its use or make other public performance of it without express permission from us"

means you cant stream anything
 
Software has always been licensed hasn't it? The part about Sony needing to give authorization to sell on disc based games is scary though. What was the wording like before?
 
You never own the proper software in the discs, you own the physical discs themselves. This has always been the case.

But on a serious note, this could just be legal shit to cover their own ass for some reason. But the fact they can enforce it is kinda scary.
 
This is just legal talk. It says "unless authorized by us" and they've obviously authorized it. No need to panic

Edit: it basically means they have a right to not let you sell used games if they choose to and it's always been the case. They're obviously not gonna do that
 
Just tweet yosp for permission every time you want to resell a game. Plenty message him pointless shit so I doubt he'd bat an eyelid.

Game software is licensed for home use only on authorised PlayStation®3 systems in Europe, the Middle East, Africa and Oceania only
You may not lease, rent, sublicense, publish, modify, adapt, or translate any portion of the Game Software.
You may not use the Game Software commercially, broadcast it, charge for its use, use it in a public arcade or make other public performance of it without express permission from Sony Computer Entertainment Europe
To the fullest extent permitted by law, you may not reverse engineer, decompile, or disassemble any portion of the Game Software, or create any derivative works, or otherwise attempt to create Game Software source code from its object code.
You may not use any unauthorised, illegal, counterfeit, or modified hardware or software in connection with the Game Software to bypass, disable, or circumvent any encryption, security, or authentication mechanism for the PlayStation®3 system.
You may not resell Game Software unless expressly authorised by Sony Computer Entertainment Europe

So no change at all then.

4. Software is Licensed
4.1. All Software is licensed, not sold, which means you acquire rights to use the Software, as described in these Terms, but you do not acquire ownership of the Software. If you do not comply with these Terms, we can terminate your Software Licence which means you will no longer have the right to use the Software.

7. Resale
7.1. You must not resell either Disc-based Software or Software Downloads, unless expressly authorised by us and, if the publisher is another company, additionally by the publisher.
 
Can we lock this thread before it unnecessarily spirals out of control? This has always been the TOS. You will see it for the old consoles as well. Not to mention other forms of media like movies. Nobody enforces it and Sony has expressly authorized it. Nothing to see here, folks!
 
It means exactly what it says it means. They have no intention of preventing you from reselling games, but legally they want to make it 100% clear that they can prevent you should they choose to. Every single software company has one of these clauses because every single software company supports software-as-license rather than software-as-goods.

Yup, it's why we consumers should always be vigilante. Any time these companies might decide to screw us, if they so choose.

On PS3 they didn't. On PS4 they won't. But we're watching, Sony, Microsoft and Nintendo. Always watching.
 
I think it's strictly talking about the content itself (the assets, code, etc.) and not the medium for which you can still sell or rent as you wish.
