SuperDaE facing possession of child exploitation material, dishonesty & drug charges

He was on my Facebook as SuperDae Dan or something, probably a seperate Facebook account I followed him when he was promising to leak Durango stuff via a tweet but never posted any updates so I took him off.

It's scary how toxic such an accusation can be, even if it were to be completely ad hominem and unfounded.

It's also scary to think how convenient it might be for interested parties to plant something and frame a person.

If it was 4Chan stuff he saved or was cached than yeah going to take a guess and say it might have been anime/manga stuff. There was one guy arrested for the same thing and I'm pretty sure he was the damn comic book story owner.

Yep. You can ruin a person, and once that's on your record (even if it was just Hentai), he'll be known as a child abuser for the remainder of his life.

Well, unfortunately, 4chan will probably cache some legitimately illegal things if you browse it enough. Mods are pretty good about banning it, but it gets posted a lot and the only way to completely avoid it is to not browse the site. I wouldn't be surprised if anyone who has ever been regular on that site could face those charges for their cache.

I also find it amusing how many people immediately think it must be a 4chan cache to bring those charges up in the first place. Actually, mixed feelings about that.

Well now... according to:

http://libertus.net/censor/laws/celaws.html google cache:

... so I guess it could be anything? A video of a kid being bullied? An internet meme? I see a LOT of internet crap falling in this category.

'child exploitation material' means material that, in a way likely to cause offence to a reasonable adult, describes or depicts someone who is, or apparently is, a child under 16 years-
(a) in a sexual context, including for example, engaging in a sexual activity; or
(b) in an offensive or demeaning context; or
(c) being subjected to abuse, cruelty or torture.

Let me get this straight, if you have a video/picture/drawing/whatever of someone that LOOKS under 16 (whether they actually are or not) that is depicted in an "offensive or demeaning way" (whatever that means) you get charged with possession of "child exploitation material" and they run the article with him possessing "child pornography"?

Nice.

I'd imagine his forbidden weapons to look like a Swiss knife or shuriken/nunchuck/samurai sword replica and he probably had a picture of his little sister in a swimsuit lying around.

or actually, just a pedobear comic.

Not saying he was necessarily framed or anything btw, if he did possess CP he needs to be thrown in jail, of course.
That transcript is very confusing though, sounds like a very convenient catch-all.

Completely agree with your first sentence. However, I don't think it's necessary for said parties to plant false evidence. From what I gather DaE was a self-proclaimed hacker. Pretty sure it would be easy for the police to find incriminating evidence under such circumstances.

lol, sounds like he's gonna be getting some ram installed when he gets his "firewall breached"... in prison!

...sorry :(

I'm confused though, what do the charges mean by an "indecent or obscene article" though? Is that like Polygon's Last of Us review or something? Seems a bit extreme...

Ok so how do they handle a teen child pornography case?

he is basically a child his self , like should a 16 year old get in trouble for downloading the R Kelly sex tape when he pissed on the 14 year old girl?

but if it's 10 year old's & babies they need to send him off to get help.

Nice.

I think so far people have been quoting Queensland, whereas this guy is from Perth right? That would place it as Western Australia which has some... fuzzy wording.
child exploitation material means -
(a) child pornography; or
(b) material that, in a way likely to offend a reasonable person, describes, depicts or represents a person, or part of a person, who is, or appears to be, a child -
(i) in an offensive or demeaning context; or
(ii) being subjected to abuse, cruelty or torture (whether or not in a sexual context)
"in a way likely to offend a reasonable person" is one of those 'fun' phrases even before you get to the rest of it.

Not that I'm protecting the guy, but sometimes people in high places want to get middle-men with whatever they can. Just saying :p

You know, he's 17. Could've been some nudes. Even on his phone. Even of himself. Kids get slapped with child porn charges for that stuff all the time.

Reads basically the same to me.
A lot of catch-all terms there.

EDIT: Oh he's 17? So he's a minor himself? How would that work?

It amazes me how these guys are so smart when it comes to computer skills, but so stupid when it comes to lacking common sense.

Considering his age, naked pictures of his own girlfriend on his cell phone would count as CP.

I don't even know him so I have no reason to believe anything really, but is this true? If it is, that's really stupid...

They should've been more specific, I don't even know what "possessing and copying an indecent or obscene article" means.

I'm hesitant to believe these charges, especially with government's going balls out nuts on cyber security and shit. Hopefully he gets a fair trial.

edit - @the age discussion: that's true, didn't consider that. If he has pictures of his underage nude girlfriend it could be counted as possession of cp even though he's 17. Absolutely unacceptable if that's the case, this attack on teenage sexuality needs to stop; I had naked pictures of my 16 year old girlfriend when I was 15, disturbs me to think that my life and other young folk could have their lives ruined by a natural urge and desire.

I recall some school mate at his 17 being caught in a sexual act with a girl of 13 I think

He defended himself saying that ''he was an underage too, so no biggie ''

Still, sounds like something to convenient

Are you one of those who think they arrest [try to at least] peole for working for wikileaks, etc. and charge them for rape, cause they raped someone?

I don't know if SuperDaE really had child porn, or if he's been framed or what. I just thought it was kinda funny how a GAFfer correctly guessed this "child porn" thing out of the blue back in February.

Wasn't Julian Assange also accused of rape and shit? I really have a hard time believing when all these accusations rain down over people certain governments / companies have problems with. Sounds like smear campaigns.

Doesn't Australia have some pretty draconian CP laws?

Don't bring that into Gaming.

Same in the US... in fact, if an underage girl sends you a picture UNSOLICITED and calls the police, they can arrest you for child pornography... even if you delete it (there would still be a record of it on your phone).

US CP laws are very strict, to the point of being unreasonable at times... There have been 10 year olds who've ended up on the sexual predator lists (essentially ending your life in a lot of ways) because of it.

He is wanted for questioning about a potential rape. They've gone to great lengths for questioning without ever having any formal charges, including things like putting him on interpol's wanted list and refusing to do the questioning over the phone/skype as Assange offered (he had already left the country when they decided to reopen the case as it had initially been dropped due to a lack of evidence).

Everything about this seems a bit off and strangely convenient. Given that this guy is 17, they really need to be more specific on what this child porn really is. I don't know if any of this evidence was planted or not, but it does seen incredibly shady.

Can't say I have much sympathy for this dude but I'll wait for the evidence/trial and clarification of what this stuff actually is before I pass judgment. Sometimes people forget how easily anyone can be charged with a crime, and there is some really stupid stuff that's categorized as child porn. I'll never understand the media obsession with ruining peoples lives/names before they're even brought to trial (not that this guy's name wasn't already by his own doing, but child porn is on its own level and deserves a fair trial before everyone starts acting like it's a matter of fact).

SuperDaE is just fucking 17?

He looked like a washed out 20 - 30 year old wannabe hipster in those pictures that came with the article Kotaku published of him.
