I don't know how many people would cheat the system, same as I don't know how many people would want to keep their amiibo in their packaging. But my main confusion is still the expectation that someone should be able to use a product without opening it.
Is the premise that Activision and Disney set a standard that Nintendo should follow? Or that Nintendo have intentionally screwed collectors? Because in the history of collectables, collectors have either not opened and not used their collectables, or have bought two. It's nice that Activision and Disney figures are different, but I don't see anything malicious in how Nintendo have packaged amiibo.
I don't think its malice on the part of Nintendo on collectors, they're clearly planning to have these be used for unlocks more than anything and want to protect that. Fans of similar types of games have gotten used to being able to keep figures in their packaging, even the more expensive one time use Skylander level packs, and I think its natural for those people to be disappointed in the move.
Its probably a non-issue for 99% of consumers but I would assume the people buying and returning would probably be around the same rate.
