Would this be considered fraud? (regarding returning an item)

It is about as much fraud as Best Buy would be commiting when you return an item for a cash refund and you don't get the same exact bills back.

Don't listen to anyone who tells you otherwise or that Best Buy would somehow know the difference.
 
If it really is an identical item, and all you do is put the BB sticker on the other one, you are not defrauding anyone of anything.
 
Just take it back if they call you on it say it was a gift and the person gave you the receipt and told you that is where they got it from must have been a mistake.

Would I be defrauding the store of I tried to pass off item #2 as item #1 in an attempt to return it? It hasn't been opened (still in shrink wrap) and has the EXACT same UPC code. I even have the Best Buy receipt and it hasn't even been 7 days.

I even looked up return fraud and my situation isn't described so I was just wondering whether or not this would be considered as fraud.

I WILL NOT attempt to actually do this and I am not seeking approval. I'll probably sell it online or something. I'm going into law and if this WAS illegal, "charged for fraud" would not look nice on my record. But I am curious because it's a gray area: I'm not attempting to make any sort of profit AND I'm returning identical merchandise.

As a current RetailGAFer, this's happened to me once. Someone tried to return an item that we sell, but with a different UPC that they had bought elsewhere, and had the receipt for the identical item that they'd bought from us.

Can't take it, but have no reason to do anything other than send you on your way with the item.

Admittedly, when you get angry about how it is the same item and flip out at me that I should give you your money for it when you've already opened/used the Frontline you bought from us, I may feel like punching you in the face. Unfortuantely, I cannot anymore than I can give you a refund.
