AP: Tom Brady's 'Deflategate' appeal rejected by federal court

NEW YORK (AP) — A federal appeals court has rejected Tom Brady's attempt to get a new hearing on his "Deflategate" suspension.

Brady was asking for the full 2nd U.S. Circuit Court of Appeals to hear the case. In April, a three-judge panel said that NFL commissioner Roger Goodell was within his powers when he suspended the star quarterback four games for his role in a scheme to doctor the footballs used in a Jan. 18, 2015, playoff game.

The decision Wednesday affirms the wide-ranging powers given to the commissioner by the NFL's collective bargaining agreement and was a setback for organized labor groups arguing for due process in employee discipline.

Brady's remaining hope is to appeal to the U.S. Supreme Court.

Brady appealed — first within the league, and Goodell affirmed the decision. Brady appealed to federal court, and U.S. District Judge Richard Berman overturned the suspension. The league appealed to the 2nd Circuit, and the three-judge panel reinstated the original penalty.

That left Brady hoping for a new hearing in front of the complete circuit — called "en banc" — or an even more unlikely hearing at the Supreme Court.

"That's always an option to litigants," Olson said after joining the case. "It is not something we have resolved ourselves to doing."

Just confirmation of how badly the NFLPA messed up during their last labor negotiations. All the evidence points to deflategate being nothing, but they gave the commissioner way, way too much power, it doesn't matter what the evidence shows. This is gonna be a major labor dispute when they collectively bargain again.

SCOTUS will turn away as well if he appeals there.

They've been pretty strict on contract law. The NFLPA signed a dumb agreement.

Because guys are basically killing themselves slowly?

Let them do their PEDs.

NFL vets have horrible health outcomes and much of the PEDs are for recovery as well.

Unlike the MLB, the NFL never had this moral, holier than thou, mentality.
 
This became more than about deflategate a long time ago. This is about the powers that Goodell has and the players have him this power and will have to deal with it

There is literally no evidence, there is nothing, and this is a bunch of bullshit. Anyone supporting this is just jealous of a winning QB or just downright pathetic. If you support Gooddell you need your god damn head checked.
 
This is the most ridiculous thing ever with the most obvious conclusion ever.

The NFL is suspending one of the greatest QBs of all-time for a cheating offense that is barely fine-worthy and they couldn't even definitively prove who did what.

But, the fact is, Goodell is fully within his right to do it. The NFLPA is the worst union in sports, by far. Non-guaranteed contracts and crazy medical liability in a league that basically prints money. They need to get their shit in order.

How? I'm genuinely curious at this point how anyone with the capacity to read would think that.

Have you heard Goodell say PSI once in the past 12+ months? No. Why do you think that is? Because there is zero proof of ball deflation. Hanging your case on one text message from 6 months earlier where equipment quy is talking about overinflated footballs in a road game (I think it was the Jets) is pretty pathetic. And when you don't have any evidence, you move the goal posts and make it about the cell phone. That same cell phone that NFL's 5 million dollar investigator told Brady was not needed, because they had all the relevant texts.

And I don't even care that much about football, but this case got me interested about what a corrupt joke of a league the NFL really is. I guess if you want to make sure there is parity in the league, when one team wins their division year after year after year, it's a good idea to bench the starting QB for 4 games.

This in a league where every single player is doped up out of their minds, yet nobody ever gets busted for steroids. Only for weed and adderall, of course. I'd like to see that special oatmeal that NFL players use to get bigger and faster than all the athletes in other team sports.

NFL makes the NBA look like a clean and wholesome organisation.

The loss occured in 2010 when 31 of 32 teams voted to grant Goodell the powers.

Pats fans are just salty that Goodell is now using those powers to fuck their team. Didn't hear them crying for the Steelers after Harrison's witchhunt in 2010 or the Saints after Bountygate.

I don't care much for Brady of the Pats, but I am concerned about what this means for the wider labour issue.

Read your employment agreement. The NFLPA got suckered. They signed off on this because they didn't think long term--which makes sense given how fragile NFL careers are.

I didn't cry about any of it. I admittedly didn't follow the Harrison situation closely but I've often spoken out against the NFL in situations like Bountygate, Ray Rice and Peterson. So you're wrong.

Do you have proof of this corruption? Because if not, better keep your trap shut.

Fact is Wells Report was destroyed when held to scrutiny, there is no direct evidence of cheating, this whole thing was never about that anyway. But go ahead, support the unjustified decision and side with the uneducated morons of the world.

Don't get me wrong, this is stupid, but Kraft dug Brady's grave with this scandal once he started begging the other owners to back him, and the fact that they basically handed this off to Brady for him to take all by himself.

But this case isn't even about any of that anymore, after the suspension was overturned it was all about the NFL vs NFLPA

Kraft didn't even contest the ridiculous fine or the more ridiculous loss of a first round pick

The only part of the punishment that was ever contested was the four game suspension
 
I haven't followed this in a long long time, but wasn't it shown that the difference in air temp wasn't enough to account for the loss of PSI?

I see you removed that reference - good call. There are better ways to 'piss on' a guy than that.

The whole rallying cry for Moira that one year, and the new girl being 1/3 Moira's age the year after didn't go unnoticed. I just didn't want to derail the thread.
