Yep. DD is totally happening. Just like Eternal Darkness is coming back because Nintendo keeps re-upping their trademark.

Until I see otherwise, "It's dead, Jim".

We know it's not connected to Dragon's Dogma (though Capcom could easily retcon that if they decided to). The connection comes from early reports that compared the gameplay to DD.

You know me Sesha. You know how cynical I usually am about DMC5 and how I worry about every little thing about it. But even I'm not worried about Itsuno working on Deep Down instead of DMC5.

The original mark was an intent-to-use application. Capcom only had a set amount of time to show the mark was actually being used (by publishing a game with that name, not just announcing it). They ran out of time. Now they have to file a new one and the old one will expire.

Basically, nothing to see here other than the fact that the game isn't cancelled.

It at least means they haven't given up on the idea.
But yeah you can make a new trademark and still do nothing with it.

This would be awesome to see at E3 2017.

And it does kind of make sense to revive right? Given how well Dark Souls and Bloodborne have done? Clearly there's a market for Capcom's take on the genre, right? right guys?

No you can't.

So you can't make a trademark for a game that ends up getting canceled for one reason or another? That's what I meant. I don't think the Trademark people are gonna come to capcoms door about that.
 
Hopefully this game does a Nioh and gets revived and turns out to be fucking amazing.

Come on Capcom I know you can still make good games.

You need to actually intend to use it. And Trademark people, no. They don't do that. But another business could and Capcom would be in serious legal trouble potentially if they were filing intent to use applications without any actual intent to use.

Taking that in would suggest that Capcom is fully intending to do something with the trademark. Maybe we can smoke them out by trying to register the trademark ourself and make a claim to the Trademark Po Po that Deep Down is clearly dead and Capcom are hogging that sweet title.

The trademark can be registered once the game actually comes out.

If the game never comes out, the trademark can never be registered.

Until the game actually does come out, all Capcom can do is keep an application on file that is approved and ready for registration.

But they only get up to 30 months per application at most, so once 30 months run out for the first application they have to file a second one to get up to another 30 months.

Damn it, I just posted in another thread complaining that we haven't heard anything about Deep Down in years, just to see this just five minutes later...

Anyways I'm hopeful, Deep Down looked like it could be great.
 
Yeah, the lack of Deep Down yet again at E3 was noticeable. At this point I've got to assume it's dead, which is a shame because it was the game I had the most hype for out of the original PS4 titles.

Deep Down was the first game that got me excited to purchase a PS4, little did i know that it was a lie

even with the HUGE downgrade it got in it's last videos, it's still look amazing and i cannot wait to play it someday

Capcom’s PS4 exclusive Deep Down is one of the biggest mysteries of this console generation, and it just gave a small sign of life once again. The publisher filed a request to extend the time to file a statement of use with the United States Patent and Trademark Office, which was approved today.

According to trademark law, the registration of a name can only be extended five times before a statement of use is provided, certifying that the trademark is being used in commerce, which in this case means that the game has been released. Each extension grants six more months of leeway, for a total of three years including the original registration. After that, the name is lost.


The request mentions that Capcom is making an ongoing effort in “product or service research or development,” implying that the project is indeed not dead. At least according to trademark law, this isn’t exactly something one can say without merit, as the statement is actually binding: it’s equivalent to “a sworn statement that the applicant intends to use the name commercially in the Unities States.”


Since this is the second extension since the new trademark was registered, the publisher has two more years to release the game before losing the name once more, meaning until June 20th, 2020.
