That won't work, the two are a complete package. Without mandating online checks, they would not even be able to enforce a policy of no used games.

Because used games have nothing to fucking do with them not meeting their expected targets, when a game costs 100 million to make you have already fucked up.
Rentals have died and evidence and research has shown piracy has little to no effect on the AAA industry and actually HELPS in the small/indi games market. Used games are the new boogyman for them to blame instead of realizing they cant manage a fucking production budget to save their lives.

They could lock it to the hardware for offline and use the regular bluray redemption the PS3 already supports for the people that have online access.
They are the makers of the system, they can freely combine the already existing and described system as they please.
Point is: They can block used games without requiring an Internet connection, if they choose to.

Doubt it, the US is the only place on earth (that i know of) that classes corporations as people. I have seen a depressing trend of court cases siding with the big boys because of lobbying. I would love it if the US turned around and said EULA's are worthless but i'm not holding my breath.

Keighly gets too much shit. He does a good job as far as TV style presentation for games media. GAF has got a lot from him over the years. Jaffe interviews and discussions top of mind for me. I like his Bonus Rounds with Jeff Gerstman and Shacknews guys too.
