Curious.I can't really talk about Californian law, but by German law at least they could get in trouble by not showing that message before every single parts gets started/entered by someone, as of now they only show this message once when you first get the update... this is a grey area and might get either sony or whoever records your voice chat in serious trouble if a court finds this one time warning to not be sufficient enough... we will see if anyone sues someone over this in the future I guess

As i have mentioned numerous times before ... xbox prevents party chat being streamed ( unless all parties specifically agree to it in the session).So. Just to be clear. Exactly what happens if someone is in a party chat and also streams to Twitch? You RECORD the chat. Isn't this warning just making clear something thats already happening???

They could've easily say we are not responsible for what users do using the voice chat function. But they did not say that, they say; By participating in voice chats, you agree to your voice being recorded. That to me sounds as Sony who's gonna play Big Brother, if not now they can easily change that in the future because the wording in the TOS leaves that option.

I think you may be reading too much into that. Don't get me wrong, I totally get being weary of voice features in consumer electronics, as silicon valley hasn't been the most trust worthy with that sort of thing, but that isn't what's going on here.

They didn't stop that practice last year, they just stopped listening in all the time. They still do the above, as stated.They stopped that practice last year. Also it's not recorded in voice chat sessions by users and straight sent to Sony for moderation. But voice messages a user sends to another user. Again not voice chat or group chat.
