I'm guessing the scenario was: The weed/paraphernalia belonged to the OP and even though his girl had smoked, the cop was more concerned with making sure someone was held responsible for the possession of the drugs.

There's illegal activity going on in a vehicle with multiple individuals in the car. I don't think a cop is doing a good job if one of the individuals says "hey can you please leave so and so out of it?" and he just says " oh ok"...

Yeah, it sucks. But cops everywhere interpret the law differently in different contexts. They are not automatons, and part of their job is making judgement calls dozens of times a day. Which makes the generally low bar for admission, training, and monitoring of police officers all the more depressing.

Also, in situations like this one, a minor drug offense, police officers may acknowledge that there is no good to be found in charging two individuals and putting them through undue hassle when the state is going to get its stat boost and its fine regardless.

Encountered cops dozens of times smoking through my teens and early 20's in various public locations. They never really cared much. Worst we'd get was a lecture, confiscation, and sometimes a ticket. They'd always jot down our names before they left. A cop came to get me in class in high school once and basically wanted me to rat out dealers. I played terrified innocent and it worked out. They searched my locker, but I was a real casual smoker and rarely had anything on me. Even if I had, it wouldn't have been enough to matter. There's no record of this anywhere, either.

Quebec (South shore of Montreal) is pretty easy going with this stuff if you're a decent person. I quit smoking a long time ago, but I know people who still do and it's still fine.

There's illegal activity and then there's illegal activity. It's not as if they were robbing a bank or burying a body or something.

The cop probably recognized that if the whole thing goes to trial the boyfriend will deny the girlfriend's involvement anyway - so why not just sidestep the bullshit? If the prosecutor contests the BF's claim of her non-involvement, then the cop has to come into court and give testimony that will ultimately be inconclusive.....thus tying the cop up for an afternoon when he could be out on the street doing actual productive work.

That's what it says on NORML but now that I look at it again I realize it must be a typo. Below the grid is says that it's only 1 year, and on the Florida Legislature site it says that a first degree misdemeanor is up to 1 year and a 2nd degree misdemeanor is up to 60 days. So since OP was told it was a second degree misdemeanor for possession that should make his maximum fine $500 and maximum jail time 60 days.

Anyways OP, its a minor offense. Not fun, but its nothing to freak about at all. A fine at most probably with a suspended jail sentence(meaning you wont be going to jail).

I've been in a minor accident with someone who was smoking pot. All he did was hit a raised traffic island -- nobody got hurt and the damage was minor, but it was a fucking easy mistake to avoid.

Since then I haven't approved of baked driving under most circumstances.

Most accidents are pretty easy to avoid and happen by perfectly sober people.

Driving high isn't recommended, but the people trying to demonize here are being kinda dumb and probably dont know what they're talking about.
