Got caught with marijuana and paraphernalia

If you are White, the judge will probably forgive you and hand you his daughter for marriage. If you are black, you're probably looking at the death penalty along with girlfriend and your entire family.
Thanks for bringing this up. Definitely the elephant in the room.

Dave Chapelle had some awesome bits on this.

This is so bizarre. That you have to get recommended to 'lawyer up' after you were caught smoking some weed. And possibly getting up to fifteen years for having paraphernalia. Is Florida really that strict about this? How's the US in general. Are most states this uptight about weed?

I can't count the times I was smoking somewhere out in the open, saw a police car drive be, and didn't worry one bit. And never had to, either. It's really got to suck to be this carefull, just for smoking some pretty harmless stuff.

And you also seem to be applying it out of the context it was intended for.

Broken Windows Theory is about vandalism and decay. It has nothing to do with casual marijuana use.

Neither one of you are understanding the context as it applies to this situation. This is critical thinking 101. While it started out as a theory on urban decay, it has been applied to a myriad of situations. I'll break it down a bit for you though.

I will quote the Wiki article you posted for reference:

Consider a building with a few broken windows. If the windows are not repaired, the tendency is for vandals to break a few more windows. Eventually, they may even break into the building, and if it's unoccupied, perhaps become squatters or light fires inside. Or consider a sidewalk. Some litter accumulates. Soon, more litter accumulates. Eventually, people even start leaving bags of trash from take-out restaurants there or breaking into cars.

Smoking weed in public is nothing more than a "broken window" to you and many others. However, it is the crack in the surface that can, in theory, lead to much worse things. These things are not necessarily drug related. For instance, if people walk around smoking weed in public and the police do nothing about it, that may show a lack in law enforcement in that area and the criminal element may become more brazen. The social norms are also enforced by busting kids smoking weed in their car with their girlfriends. Responsible adults do not engage in this behavior and this is a good way of letting busted teenagers know this fact. Both he and his girlfriend will now tell others within their social network about the ordeal and others will likely weigh the pros and cons before committing the same crime. There should also be a fear of "If I was punished this harshly for something breaking a law this small perhaps I had better not engage in breaking worse laws".

This theory is just another way of phrasing a popular idiom people use: "Give them an inch and they'll take a mile".

Did the OP learn his lesson? That is paramount to all of this.

lol at people in this thread that are worried about stoned drivers.

Eh, I'm of the belief that anything that impairs or alters your mental state in a significant way should not be mixed with driving a vehicle on a public road.

I have absolutely no problem whatsoever with casual marijuana smokers (and really hope TC gets all this sorted without hassle),but try and leave the car at home or wait until you're not as high - not just for your safety, but for other drivers too.

People are seriously overreacting here and I doubt a lot of them have any experience with this sort of stuff.

You dont need a lawyer for such a minor offense. Unless Florida is somehow a crapton stricter than other states, he'll get a fine and a suspended jail sentence at most I'd bet. A lawyer wont be able to get anything dropped or reduced. And these people posting maximum punishments are scaremongering. Nobody gets the maximum sentence for a first-offense misdemeanor.

OP do everything you can to avoid it on your record. My bf's bro was charged with the same thing and he can't find a job because of the background checks.

Most likely just probation and a fine. I mean my friend smoked on school ground and he wasn't given no fine just community service and ISS for half the school year. This was years ago

Driving while high isn't really that dangerous unless you are stoned absolutely out of your mind, and judging by the amount of weed the OP was caught with, he should have been fine.

"Can I take your order?"

"Can I take your number looooool"

What the fuck is this.

Also what is the point of driving stoned if you can drive just as good without being stoned.
I guess because I've never been stoned, but I just don't see the point.

I also wanted to say that when you smoke you seriously smell like shit to other people, I was in class last week and this guy came in and was all stoned and he sat next to me and I fucking had to pull my chair away from him and try not to breathe for the rest of the class. He also put Axe on to disguise the smell but it ended up smelling even worse and I was just laughing at him. I feel bad.

There is most certainly an effect relation with the amount smoked, but let's not encourage this. It adds unnecessary distraction and unless it's an emergency, plan to keep it at home people.

Different people react to weed in different ways.

Shit, some people react differently to weed at different times.

I went from a daily smoker to quitting because shit suddenly changed when I turned 23.

I have no problem with people smoking weed but don't drive while high. I don't care if you think you can handle it. There are people who also think they can handle driving after drinking.

Friday, right in front of the new building on campus, there was a couple smoking weed. They were so out of it, and curled up against each other. It was cute to say the least, and they weren't arrested. Nobody gave two fucks, plus the whole area near the dorms smelled like weed.

Friday is party night for the campus, but you can see how the criminal justice system is selective and isn't just for all; it uses discretion and varies by region, time, and space.

Sometimes you are lucky, sometimes you are out of luck.
Which is why I suggest that next time you stop tempting fate, and do your dope in a private area.

You weren't too smart about it, neither were the campus couple, but the only difference is: you got caught.

Oh for gods sake. He'll get probation and maybe some drug classes. It wont be a felony so it wont come up on background checks.

Would you mind expanding on this?

I smoked weed every day or nearly every day from 17 years old until, at some point when I was 23, when my highs became very different.

What was once an enjoyable, mellow high when I was younger became far too intense almost immediately after taking a hit or two. My heart would race, I would get far too into my own head, paranoid and anxious.

I'd love to be able to smoke weed again, and have tried intermittently over the years, but something changed within me and smoking weed is now a completely unenjoyable experience.

pay for a lawyer.

and start saving for college... student aid/loans get a lot more complicated when you have a drug charge.

this is my story as well...

You're best shot at getting a reduced sentence is to hire a lawyer. Drug charges have severe consequences in life... beyond the possibility of incarceration.

This.

I smoke, all day err day. At work on breaks, during lunch and before and after work. I have a high tolerance so im not getting toasted. Just a bowl each break. More relaxing than anything.

You need to be smart about it though. I commend you for not bsing cop and taking the blame instead of sharing it with the gf. You dothe crime you pay the time. Godspeed brother, hopefully one day we wont worry about smoking in public.

you really shouldn't drive stoned, especially with other stoners in the car

i'm aware that different strains, amounts, and personalities can contribute to the differing effects felt by different people. however, in my experience, having driven stoned and being around other inebriated drivers, it becomes incredibly easy to become caught up in conversation, tinker with stereo systems, daydream or otherwise lose focus of the road, especially in that initial half hour.

That is exactly how it is for me (22 here). I never really enjoyed my high too much, but recently it has been exactly as you just described it. =[

Yep, me to. My friends kept telling me how amazing it was, so I have tried multiple times but all had the same reaction: Heart racing, anxiousness, paranoia etc. etc.

I'm 26 BTW.

Yea driving high is straight as long as you're not to high. Just like driving kinda drunk is OK cause you're not blackout.

And I think the point is that responsible adults don't go sit in a car in a public place to smoke weed. But yea I guess you're so responsible that you just read that as adults don't blaze haha stoners.
