Yes, because I don't live in the US and SCEE is (probably) unaffected by this. Japanese console in the EU should be the safest option for me.
Hah. Most EU states are collaborating with this telecoms snooping stuff, despite protestations for public consumption.

I think given the scale of the US' coercion of companies... It looks a tad naïve to assume your 'privacy' is safe just because the company your games console is built by hails from Japan.

The terms "probably" and "safest" don't mean anything to you? To put it in your language: It's the most balanced option.

I assume those getting upset also do not ever use the internet, cell phone and somehow avoid all street cameras? Right. Here is a tip, it's all monitored (in the US at least...and if you are Angela Merkel).

Not only that, but if it's in written terms that they are doing one thing and its ever found out that they are doing another it would cost them billions.
 
If any American thinks any of their communications are private now I would be shocked. We are a monitored society through and through; sad what it has become and what we have let happen to us.

there's a difference between making deliberate searches/calls on a computer / phone and having a camera & mic array permanently installed in your home.

The more correct comparison would be if your phone had its cameras and mics permanently activated, or the ability existed for a 3rd party to remotely activate them at will. While I don't really care that my calls / searches might be monitored (other than the principle of it), I would throw my phone out if this possibility existed.

Was it Germany that label Xbox One as a surveillance device? Given the on-going, recent scandal of NSA , how's the public reception after all the 180s?

ie; Your data is mined and sold to advertisers, developers and content providers for user specific ads and to see if their content or ads are "working" based on your facial expressions and body language.
 
So the numerical values of you are destoryed, but everything they learned and discovered about you from analyzing those numbers are stored and shared with third party companies and government agencies.

Call me crazy, but this doesn't seem like a big deal. My trust levels aren't really high with MS, but if it's in their privacy statement I doubt they're lying about it.

Ah, this asinine talking point is finally back. How I missed you! "Don't like the idea of a camera in your living room, well you might as well leave your front door open! What's the difference anyway, right?!" It's baffling how some people refuse to acknowledge different degrees of privacy.

So I ask again, why would Sony or Nintendo be compelled to hand over data?

I know the US likes to act as if it runs the world, but they actually have no power over other sovereign governments unless they invade them... a viable option I guess ;)

This subject has become somewhat derailed from the "privacy issues of Kinect" and moved to NSA spying like most privacy discussions these days. Sorry, about that but I felt the need to try and correct you as passing on misinformation. The US reach is scary enough without saying they can freely access all of Sony & Nintendo's data too. I hate false equivalency.

If someone has genuine privacy issues then selecting a non-US company for their entertainment is actually a viable option.

Would NoA or SCEA count? as territorial subsidiaries of their parent companies, they operate solely within the US.
 
They say they don't share that data but even if they did, NSA gag orders make it so they can't admit to it.
So this whole privacy statement is completely worthless.

I take it you can opt out of this via privacy settings?
So... I take it nobody knows? Because I could've sworn MS said that the user was in control of any data Kinect collects, especially as regards any information that could leave the console.

That begs the question: is it destroyed by MS or by any/all entities between the transmission and ultimate reception points? Just because MS itself might destroy the data, there's no reason to think the NSA, an MS subsidiary or affiliate, or paying third party entities can't gain access to the data and separately store and analyze it.

Also, if it really says that "no one" can understand the facial data, I can't see how that's possible. Wouldn't it be that "anyone" with the decoding algorithm could reconstruct the key facial points?

Pretty sure I need to do all of those things in my everyday life, while I could live a fantastic life never touching Kinect. So those arguments are always silly as far as I'm concerned when you're attacking ordinary things that we do in defense of one out of three game companies attempting to force a camera into your living room to play games.

Makes some sense. Anyways, Microsoft better be honest when they say the data can't be used to identify you, and that it IS deleted after being analysed to improve game play. STILL, I want the option to opt out like on 360. I wouldn't opt out, I opted in on 360, but still, the option is nice.




Well, uhm, You are totally leaving out the part, right before the parts you quoted, that states that "Microsoft says it may monitor communications “to the extent permitted by law, but we cannot monitor the entire Service and make no attempt to do so.”



So sure, they warn that others could record what you say, or record your videos, but before they even say that, they do mention that they may also monitor these audio and video feeds as well.

A guy did say "No I will not give my data to the NSA, it's unconstitutional". He was brought to court and told by the judge to do so or he would go to jail. He did, by giving them a 12 page, full page, size 3 letter, encryption code, printed. he refused to give them the digital version. The FBI said that it was too hard, because they had to enter it by hand and one error would make them start from scratch.

The problem is that the NSA is unconstitutional and do not work by law. If a company is asked to give the info to the NSA, they do it. If not they get thrown in jail. America is becoming more and more a police state. Even England is falling into that. A journalist had sources and info on Snowden, and obviously didnt want to give the sources to the police. The police got a mandate, and raided the journalist office. They searched everywhere, including the journalist house.

Really it's becoming scarier and scarier for some countries. So yeah, I wont trust Microsoft to put a shield in front of my info for a webcam connected to my living hood that may or may not be on at all time. And I'm not even American. I'm Canadian.
