I seem to recall the same thing happening in Infamous Second Son regarding not being able to climb to the top of the Space Needle. I also seem to recall it was because of suicides that have happened there in the past, although I may be wrong on that account.

Sorry for the double-post, but since sticking to and climbing buildings is the essence of a our friendly neighbourhood protagonist, it was probably a design decision not to have such a prominent building acting as a web-slinging blindspot.

Wait, you're telling me that this fictionalized version of New York, complete with fake buildings like Oscorp, Stark and Avengers buildings (which replace real buildings FYI), isn't accurate? Why, I never! :p

Seriously though, this is a strange thing to get worked up over. But then again, this is the game where people are going crazy over a puddle so...
But it is the tallest building in the city. I think it should be in the game. I'm sure many people would be upset if the game didn't have Empire State Building. It has been in all the previous games. Also I don't think The Avengers building replaces any famous real building. It isn't like in the MCU.

I think this happened with Spider-Man 2: Enter Electro back in the day. They were visible in the background of a level and had to be removed. I could be mistaken, I vaguely remember reading about it in a magazine near release.

But you do, especially if the rights are owned. Same thing happens with sports stadiums and the like, you need a license for use in media.

This would be the correct idea. Probably why they won't make many games in Vegas, the licensing headache would be off the charts. Unless it's like GTA:SA where they just make up a bunch of random casinos instead.

Also, it's probably for the best they didn't license the One World Trade Center as then this could end up being delisted later down the line when the license expired.
 
It's a legal thing. (legal protection of buildings, something something)

You can only have certain buildings represented in the game that are old and even some of the older ones can't be defaced, destroyed etc. In their case, they probably just removed it completely instead of designing a completely new skyscraper from scratch.

They replaced it seemingly with a design similar to one of the earlier designs in the running. So a building with that height is still there, and it has also been confirmed this is an "alternate universe" as well. Something Marvel loves to do to avoid continuity and plot hole errors.
 
Put the Twin Towers in instead. Vastly superior to what the 'still unfinished' complex is now.

I am lucky to have been able to see and visit them in person in the 90s. Should have rebuilt them. They are greatly missed.

They can still be seen in the movie though. You can see them in some scenes. That trailer is great but it wasn't even directed by Raimi for some reason.

I've got a feeling that this might be something to do with the fact that you can interact with it, it probably affects some part of any passive licensing.

Makes sense since the tower was build to commemorate 9/11. I could see why there would be a pretty strict 0 interactivity with the building rule. You probably don't want anything even close to 9/11 imagery.
