They'd have to somehow tangibly prove they are in fact losing sales, because right now any of these future games can be put in a PS3 and played.
So no, I really doubt 3rd party devs are going to start up in arms legal battles, even if it took 1 month of downtime.
And I really doubt on a mass scale consumers will all stop buying games. This however is all hyperbole, and until sales figures are posted in a month or two, we won't really know.

Sony will most likely be compensating people to some degree, developer and publisher relations haven't been exactly helped by all this. And the worse Sony's PR department handle it, the more frustration that will come out of it.
It won't just be consumers pissed off at all this.

Definitely agree with that more so that retail releases, as retail releases still go into the shops unharmed.
For the PSN devs I guess it's just a case of seeing how sales go once PSN is back up. People will still buy worthwhile games, maybe even more so if they've been sitting on their wallet for weeks
Devs I guess will be more sympathetic towards security related issues, any network with rampant piracy or security threats harbors some concern. I'm sure one of the issues just before downtime was some sort of custom firmware allowing PSN games to be grabbed for free.
