So Target shipped someone an Xbox One already? [Update: console-banned until launch]

It's amazing how much a lot of you know something, about something you know nothing about.

Go and get a copy of Gran Turismo 6 and start uploading gameplay and images across all social media sites. Include your PSN username. See how long that lasts.

At worse the videos will get taken down.

The only thing Sony has ever banned for is CFW and even then they leave it for quite some time (unless you are actively cheating online) There was actually a point when they sent a polite notice
saying "if you go back to OFW" you will be fine.

Well, that's quite an interesting response for me. I'm not interested in whether Sony won't or will do what MS have done to a certain gamer recently, I'm more interested in the fact that he suggests perhaps there WILL be some PS4s out there before the launch day.

I'm glad that I won't be banned for getting a PS4 early. Thank you, based Yoshida.

If it was automated it would have been instant ban as soon as he connected. Unless the program was very poorly made.

incorrect.

all the bans are slightly delayed (i imagine whilst it goes through and checks its shit)

you honestly think, seriously that there are people 24/7 sitting there waiting to click 'ban console'

if so, wow microsoft, get some software engineers that will save you money and improve efficiencies (i highly doubt this is the case)

all the bans have been delayed that ive seen on live, its not insta.

LOL, that's awesome. Is that you?

Nope.

Exactly what I expect Sony to do. I don't know if there even is another company who handles early releases like this.

And again this shows how much more committed Sony are with there messaging and how much more in touch with there fans they are.

And this is the uphill battle MS must endure. There could be 15 cool features the guy unlocked but the one that isn't will garner the most attention. They did this to themselves but it still represents how leaks often play out.

What did they do to themselves? MS knows what is all up and running and what is not and so they decided like this. Of course they knew people would hate about the ban but I think they thought this is still better than the hate on features that are not ready at this time.

MS didn't ban him because he was using it. They banned him for the youtube stuff.

It's a little hard to believe it was automated. Automation would allow for it to block the system from originally logging in, stopping the need for a ban. Furthermore, they were well aware of him, because they took steps to have the youtube videos removed - that means a person actually took an action.

I don't think someone taking down the Youtube video was automatic. It means someone saw this stuff and was consciously reacting to it.

I have videos with Xbox One in the title that have footage of Xbox One games, often unflattering footage. Hell, someone high up in Microsoft Games contacted me about the footage and explained why it was in the shape it was, but they never asked me to take it down nor did it trigger any automatic flags.

I am not quick to believe this "automatic ban" stuff when the pieces don't fit together, though I have no doubt that Microsoft now has an out when it decides to explain this one away.

I'm sure some of the most ardent defenders will write the excuses for them.

agreed. and there are specialist companies for this which MS has probably hired.

im talking the console hardware ban is automated and completely unrelated to the copyright infringement notice

Can you point out the specific clause in the TOS that applies here?

Serious question: can you quote for me the part of the XBL TOS that he violated? Is there a part that forbids users from sharing details of unreleased hardware and software on social media, or forbids players from using unreleased software and hardware early?

"Attempt to disassemble, decompile, create derivative works of, reverse engineer, modify, further sublicense, distribute, or use for other purposes the Services, any game, application, or other content available or accessible through the Services, or any hardware associated with the Services or with an Authorized Device. If you do, we may cancel your account and your ability to access the Services, and pursue other legal remedies. We may take any legal action we deem appropriate against users who violate our systems or network security, this Agreement or any additional terms incorporated or referenced in it. Such users may also incur criminal or civil liability."

They're talking about modded hardware, but honestly it's vague enough they could probably use it to justify an XBO early banning.

I would stay in bed if I were him.

It had to be done lol.

its not looking through a list thats millioms of lines long. it would take a sec to match the id compares to the thousand or so out there.

edit: theres like 80million 360s out there. big difference.

I agree. Someone actually did that, a person.

As for the automatic ban, I don't think that's the case but it could be so I won't dismiss it outright. It's a valid point to talk about that's for sure and a possibility.

You don't even understand what that means, do you ... Because you're using it wrong.

think about it logically people. the ban has nothing to do with youtube.

its all about the hardware connecting in and it triggering the systems....

if he had posted the xbox one unboxing to youtube and never connected to Live, there would have been a copyright infringement handed out but no ban

they are not related

I'm not seeing how this applies specifically to street dates. Based on this clause if you are applying it to this situation, they will ban everyone who posts an unboxing video even after the console release.

My next console will be a PS4, but it was interesting to see what the xbox was like.

The games and UI look good and rather than ban the console Microsoft should temporary ban his gamer tag till release date (at most)!

Damn shame, I hope its rectified by MS before launch, the lad got the console early through no fault of his own and its better to get personal opinions than a gaming websites opinion as they will be more truthful I feel.

MS if your reading this thread unblock his console or give him a new one to apologise. He has done better PR for you than your PR department. Time to show good grace!

What? That would be stupid!!
What he does with his console (that he paid for) is his decision. If he wants to put it on youtube he can do it. No need for a ban

That doesn't seem to have any relevance to this situation.

No they took down his Youtube video citing copyright claims.

Later they Ban his Console.

Unless you are telling me, you can receive a console ban because of your actions on a totally unrelated separate service?

The bottom line is that this guy will get his Xbox One unbanned, eventually.

EDIT: Yes, yes, it's just about modded hardware, I get it.

Does his console banning mean his console was simply banned from accessing Xbox Live? He can still use this console, he just can't connect to live. No?

What a crazy turn of events, I went to bed at 2 AM actually pretty sold on the Xbone and thinking "hey they turned it around, this looks awesome". Now I find out they were total dicks to this guy.

Did they ban the console or just his Live ID?

Same here. It was such a wonderful thread when I went to bed. I was totally getting excited about the Xbox One. Those feelings are now gone. Huge thanks to the dude that posted this stuff. You are awesome and I hope they lift your ban or fix this in some way.

Streisand effect will probably get take care of it. He'll probably end up with some more free shit as well and all MS gets is another RP disaster. Not sure if that it will be worth it.

I wonder if his TV guide still works? It was an early concern that getting banned would also impact TV viewing.

Yeah the negative PR alone will most likely get his console back online, on the 22nd anyway.

I think MS should of contacted him or sent him a message or something telling him to take his Youtube stuff down and stop posting UI pics and info on twitter or whatever. Atleast warned him.

Does his console banning mean his console was simply banned from accessing Xbox Live? He can still use this console, he just can't connect to live. No?

If this was the PS4 then yeah he would still be able to do everything offline, but with the X1 pretty much everything is behind the Xbox Live Gold paywall. So basically he can watch Blu-Ray's and play games offline lol.

He did not download KI so I guess he can play the CoD SP campaign till the 22nd.

This. Or at least when he went to download the patch. The fact that it happened hours later after MS moved against his Youtube video makes this obvious to me.

I was under the impression that they have never unbanned a console - only profiles.

Regardless, the point of keeping the discussion going is so that he gets some satisfaction out of this - either an unbanning or new console and no cost. It's just unfair for Microsoft to attack one of their cheerleaders.
