Seems to be some debate about whether the jurisdiction decision is final?
Psychotext said:lol, that's hilarious given the "evidence".
Zoe said:Ouch, she granted the TRO AND the impoundment.
I wonder what tipped the balance with regards to jurisdiction.

Not enough facepalms in the world.linkboy said:Sony probably slipped some money into an offshore account in the Phillipines.
iapetus said:And when you find yourself saying that about an argument that circulates around "He was soliciting money in this state because we sent some unsolicited money to his account" and "This PSN account that matches none of his details but has a name similar to his proves he agreed to let us sue his ass off here" you know it's really weak.
N.A said:What amazes me is one of the main reason the order was granted is that the judge thinks this will stop the spread of information. Good luck with that!
I'm no legal expert but this doesn't mean they're going to win or anything, just a temporary inconvenience for Geohot really. I wouldn't consider it a lost cause yet.N.A said:Temporary Restraining Order Issued in Sony vs. Geohot
The judge has granted Sony's request for a TRO (Temporary Restraining Order) in the case against Geohot (George Hotz) and the other named defendants. It has also been ruled that Sony has shown sufficient cause to keep the case in San Francisco.

Gotta love the American legal system & the DMCA :'(

BoboBrazil said:Have you seen the evidence Sony used to get this in California? Just because she is a judge does not mean she has a clear understanding of the evidence used in this case or what any of technology referenced does. She is pretty much just taking whatever Sony says as truth.

Well it's punishment of some kind. Could give others a reason to not spread security exploits on the net. Should have kept it to himself then he'd really be doing what he want with his PS3 without a big legal drama behind it.

Do we know what reason(s) the judge decided to accept the TRO?BoboBrazil said:Have you seen the evidence Sony used to get this in California? squatingyeti said:Are you happy for the TRO? It sounds like you believe he should be punished for exercising his consumer rights. Serves you right geohot! My gosh, doing something with a product you own. Ought to be ashamed...and punished.
I may be misunderstanding you, but there are really people that feel this way.

BoboBrazil said:Apparently also a fake psn account and a paypal donation Sony sent to his limera1n donation paypal account warrants the case be held in California.
jcm said:Those are really weak. What the judge actually used was the "effects doctrine", which apparently means the because Sony is the injured party, and they are in California, California has jurisdiction. The appeal of the case the judge cited is here, and has a good discussion of the reasoning.

CFW for the mother fucking win!
Ok, i see, thanks for the info Well, even if his CFW didnt allow piracy, he did post the PS3 decryption keys publically online, which can easily lead to piracy and abuse (i'm pretty sure that Geohot knew this as well), so i dont think that this is a totally moot point. But i agree that it wont really do much good in the big picture now that the PS3 keys are "everywhere" on the internet.BoboBrazil said:The judge found that the plaintiff aka Sony, is" likely to suffer irrepairable harm without the presense of this temporary restraining order". Yet she doesn't understand that what he did did not allow piracy, and is still public information posted all over the internet making this useless. Apparently also a fake psn account and a paypal donation Sony sent to his limera1n donation paypal account warrants the case be held in California. Also, apparently she found that this is in the best interest of the public...why? I have no idea.
Out of curiousity, who is surrendering their consumer rights here? And in what way are they doing this?squatingyeti said:Seriously, I love how people will surrender their consumer rights because of something so trivial that some OTHER douchebag did. If you have CFW, Sony has every right, and should ban you from PSN. BTW, people need to get this through their head, MW2 was hacked BEFORE the jailbreak or CFW.

I didn't know so many people with arcade boards at home, I mean they're really expensive and the method/device used to dump the roms is not common place at all...

It can lead to that, just like jailbreaking an iPhone could. In the end, it is your device and if YOU do something illegal, YOU should be held responsible.test_account said:Ok, i see, thanks for the info Well, even if his CFW didnt allow piracy, he did post the PS3 decryption keys publically online, which can easily lead to piracy and abuse (i'm pretty sure that Geohot knew this as well), so i dont think that this is a totally moot point. squatingyeti said:wow, first you start nonsense in the CFW thread, now anywhere else. You think homebrew is just going to magically appear so quickly? How quick do you think it is to code something like XBMC for PS3? You can't see Linux get mentioned because you're too busy insinuating everyone is a pirate. Enough already.

Do you know that a disgruntled Sony employee is who made all this possible?

and yes backup tools and emulators have appeared incredibly quickly yet we don't have any hints regarding Linux coming back, are you refuting me that? you mad with 3.56?

Because you have now displayed absolutely NO clue in the complexities involved. YES XBMC has been discussed. YES, linux has been discussed. I would LOVE XBMC on my PS3, but it is nowhere near as simple as porting an emulator or quickly throwing together a BM.and yes backup tools and emulators have appeared incredibly quickly yet we don't have any hints regarding Linux coming back, are you refuting me that? you mad with 3.56?

Yes, when they go to court, hopefully justice will be served in a similar fashion as the iPhone justice. Are you also against that?great news by the way, justice should be served.

no, you're seeing what you want to see, that comment was aimed to those users blatantly making clear they were using CFW for piracy, not for all CFW users, stop trying to get me banned or something with the rhetoric bs. I understand you're butt-hurt but please, leave it at that.

first of all I'm not bitching but expressing my opinion, and I'm being attacked/insulted for that, that's unfair (it's 2011 people) everyone is entitled to an opinion, so my Geohot comment is a banable offense now? why? and the thread you mentioned is not for the matter at hand, is for CFW users which obviously I'm not supporting, ever. I didn't know people so sensitive here with my personal opinion on Geohot and his friends and what they brought to the table, wow you really love playing Dragon's Lair NES on your PS3's. Carry on with the thread and stop derailing it, it was just my personal opinion on the news FFS.
It depends on the situation in my opinion. TPB (The Pirate Bay) has been convicted 2 times for piracy related things eventhough that they never shared any pirated materials themself. But still they got convicted because they should have known that their site would lead to much piracy.squatingyeti said:It can lead to that, just like jailbreaking an iPhone could. Ok, i understand what you mean. But i dont think that people are necessarily giving up their consumers rights because of this. I think that most of the anger against CFW are about potential online cheating, not towards people who use CFW for legitmate things But i think that it is more about having understanding about what Sony did. I can have understanding for why Sony doesn't want CFW to happened (because it can lead to piracy etc.), but i dont give up my consumer rights because of thissquatingyeti said:Many of the people wishing pain and suffering on geohot and the CFW scene have already stated they would have no problem with Sony bricking consoles or instituting any other draconian anti-consumer action. Thus, willing to surrender consumer rights.

Stop freaking mentioning the iPhone. This isn't an iPhone. It was already said that because of this shit people will have read/write access to the memory on the fly. Do you have ANY idea how much of a cluster fuck online gaming will be once someone releases an app like CWcheat?squatingyeti said:You said: "'Backups' (lol)" Quotation marks around backups and even the extra lol to get your point across. If Sony cant patch up the security because of the PS3 decryption keys were posted publically online, and if this leads to that it is impossible to prevent piracy, then this is kind of irrepairable damage in my opinion. It is not sure that PS3 piracy will have a big effect on Sony's income though.BoboBrazil said:Also, re the article above regarding an effects doctrine, what harm did what he do actually cause Sony?
