I don't know why I always get fooled by obama. Fuck his silence on this. I figured a hall of lawyers would 9vwrturn it anyway. But it wasn't even a thing to begin with. I do feel duped. And everyone I past it along to sighed relief.

In other news, the presumptive future governor of North Dakota condemned the administration for delaying the pipeline.

Doug Burgum, the Republican candidate for North Dakota governor, criticized last week’s decision from three federal agencies to halt construction of the Dakota Access Pipeline near the Standing Rock Sioux Reservation.

“It’s like you win the game, and then you find out five minutes after the game is over that you didn’t win the game because we’re actually thinking about changing the rules of the game that you decided to play,” Burgum said in an interview Wednesday afternoon. “That’s a much broader problem for our entire economy.”

And the 3 congressmen of North Dakota have all called on the administration to provide money and resources for authorities at the protest.
Senators John Hoeven and Heidi Heitkamp, Congressman Kevin Cramer and Gov. Jack Dalrymple today called on the U.S. Justice Department to provide law enforcement resources to ensure public safety during ongoing demonstrations in North Dakota.

“Since the administration created this problem, it has the obligation to fix it,” Cramer said. “It’s long past time to restore order.”

In a conference call with officials from the Department of Justice, Interior and the Army Corps of engineers, the delegation and governor asked for:

• Immediate additional federal law enforcement officers to assist local law enforcement in their efforts to keep the peace.

• Federal funding to cover the cost of additional policing. The state has already spent $1.8 million to date and estimates it will spend approximately $125,000 a week based on current circumstances.

• A clear and timely resolution on the Dakota Access Pipeline project, apart from any review of the current process for consulting with tribes in the future.

Are they being denied any lawyers, or just these lawyers? Because many tribes absolutely have their own court systems, so it is entirely possible that the lawyers they are requesting are licensed to practice law on the tribal property but not in a North Dakota or federal court.

My firm has sued the local Indian casino for various torts occurring on their property, and we have to bring the suit in a tribal court and use a "local" tribal lawyer to file the pleadings and attend court because no one at my firm is licensed to practice law in their tribal court.

I am not sure, again, since it's so hard to vet anything from this situation, but my understand is that yes, they are tribal lawyers.

But even so that doesn't make sense to me, because they are still lawyers and should be able to see their clients. Then again, only a few years ago it was legal for non tribe members to commit crimes on tribal land because they couldn't bring charges against non natives, and the justice system didn't in practice do it for them.

Obama actually answered a question someone asked him in Malayasia about this topic. The woman's question was, in relation to what is going on at Standing Rock, what more could Obama / the government do to ensure Native rights and lands were protected, as well as the environment. His answer was pretty brief and cookie-cutter, yes, but technically he did respond to the topic publically.

I think, unless another random person poses a similar question at a meeting like this, Obama won't make anymore comments about it. At this point, if Obama or the Obama administration really cared, wouldn't they speak out about it more? It's a real shame we can't get real mainstream reporting on this topic still besides the hardcore liberal places like NPR. Wonder if Sanders speaking about it will help push some momentum.

It's no different than if I tried to cross state lines and represent somebody in Georgia, where I'm not licensed. Without a law license for a particular jurisdiction, the fact that I'm a lawyer *somewhere* is irrelevant. That's just how it works.

There are mechanisms for attorneys licensed in one jurisdiction to practice in another. For example, they can apply to be pro haced in (pro hac vice admission), which is, essentially, an admission to represent a party in one specific action. However, most states PHV rules (including North Dakota's) have language like this in their pro hac rules:
Pro hac vice admission is required for all nonresident lawyers admitted and licensed to practice law in another state or the District of Columbia, but not licensed in North Dakota, and who engage in the practice of law in this state by appearing, either in person, by signing pleadings, or by being designated as counsel in actions filed in state courts, administrative agencies, or tribunals.

It's more because the pipeline was approved by the corps of engineers, the pipeline is being built on federal land, and a federal judge dismissed the protesters plea for a halt to the pipeline construction.

His hands are tied on this legally so I get why he can't say much about the subject.

What is Obama supposed to do? He's not a dictator. He can't (afaik) just, by fiat, order them not to build the pipeline, and considering they've continued construction after federal agencies asked them to voluntarily put it on hold, it doesn't seem particularly likely that his bully pulpit would really do much of anything.

Yes, it's archaic as fuck, but it works. That how the NRA and other groups get shit done. They spam the shit out that mailbox, regardless of actual issue, and politicians dread that.

The company building the Dakota Access Pipeline has purchased 20 parcels of land totaling more than 7,000 acres north of where protesters of the four-state oil pipeline are encamped on federally owned land and where the Standing Rock Sioux Tribe claims sacred sites were disturbed by pipeline construction, property records show.

Dakota Access LLC bought the land from cattle ranchers David and Brenda Meyer of nearby Flasher for an undisclosed sum, according to the warranty deed filed with the Morton County Recorder’s Office.

The land they sold includes a segment of the pipeline route west of Highway 1806 where the tribe claims burials and other sacred sites were disturbed by bulldozers on Sept. 3, leading to a violent clash between angry protesters and the pipeline’s private security personnel armed with guard dogs and pepper spray. Both sides claimed injuries.

One of the other patients at my mental health center mentioned that he'd be heading out to join the protests in North Dakota with a friend. I wish him luck but I don't really know him well enough to ask to join him...

Man that Huffington Post article is nuts. Pretty obvious something fishy is going on with this whole situation and the powers behind them. And I still don't hear about this whole mess all that on news or other places.
