Xbox One Backwards Compatibility Includes Nearly 20% Of 360 Library

Out of curiosity, what's the reason that Microsoft needs to relicense every title for their BC effort, whereas it never appeared necessary in the past (PS1 -> PS2 BC, Wii -> Wii U BC)? I assume them being able to sell digital copies of games is a factor? Could it also because of their emulator solution, which requires tinkering with each game?
Because they are being repackaged and redistributed as a technically-new executable on a new console, even if you pop in the disc. On PS2 and Wii and Wii U you're just playing back the original physical media directly.
 
This is what bums me out the most about having to choose a PS4 to play Nier, I adore the effort Microsoft is putting in to this.
