The stiff, expressionless face and awkward hands should be a giveaway. New Smash models have extra attention on facial features, so the crudely morphed T-pose in the first one isn't too convincing. Calling fake.
I can't double check since I'm at work, but I kind of assumed that the 3DS version didn't have as much attention to detail in terms of finger/hand poses and facial expressions due to the fact that during a normal battle you really wouldn't be able to see them because of the size of the screen
