I can't believe this defense worked. Is it really possible to choke someone to death like this? I'm under the presumption that at best they were doing something else on the risky side and it went a little too far. I don't understand how you could accidentally kill someone during oral sex.....like, it should be clear to you when someone is choking to death on your penis.

Richard Patterson, 65, of Margate, was acquitted Monday of second-degree murder. His attorney, Ken Padowitz, argued during trial that his client accidentally choked Francisca Marquinez, 60, during oral sex.

Assistant state attorney Peter Sapak questioned why Patterson didn't call 911 right away and reminded jurors of testimony from an ex-girlfriend, who said he told her that he choked Marquinez. He also re-read a text message that Patterson's daughter said she sent him to him the day after Marquinez was killed.

Before the trial began, Padowitz filed a motion asking that the jury be allowed to see Patterson's penis, but the defense rested before Broward County Judge Lisa Porter made a decision.

The larger question is it possible for someone to accidentally suffocate like that? As soon as you start gagging your reflex is going to be to pull out the obstruction and get your head away. It seems to me that you'd have to be held and forced down.

I guess I'm not entirely sure how choking/strangulation works. To kill somebody wouldn't you pretty much have to continue choking them long after they passed out? It seems to me you would have to ignore a ton of warning signals to actually kill a person.
