Nintendo has taken back potentially stolen Nintendo Switch

Well, I don't know where hihoptherobot lives, because this is mostly governed by state criminal law, but in my state, there are penal codes/statutes regarding the receipt/purchase of stolen property. There is an intent requirement (meaning that the person receiving/buying the property must know it was stolen) and it is somewhat difficult to prove, but you can infer it through circumstances, such as the fact that it was bought two weeks ahead of time, where it was bought from (i.e., not a licensed seller, etc.). It would probably be difficult to prove for a prosecutor to pursue criminal charges in court and win, but either way, a defendant's going to rack up bills fighting it.

In terms of civil litigation, I'm not sure what Nintendo's rights are, but it seems to me that the prudent thing to do is just give the console back to them, rather than incur legal expenses.

tldr; Both sides probably made the smart decision here to avoid the worst outcome.

So he tried to sell it and the serial number can be seen. Nintendo did the right thing and got their system back and didn't do anything further. Just close the topic and leave it at that. Nintendo did the right thing.

If I had a Switch this early, and didn't know it was stolen, I would consider selling it, because you could get quite a lot of money selling a physical Switch at this point. Admittedly, it would have been worth more before the videos were released of it.

People on GAF were telling him to sell it when he first posted about it. So what if he did? IF he didn't know it was stolen, then how is he now the thief for selling it to pay for bills like he clearly said he was considering at the time?

Why are people amazed that he tried to sell it? If I had a Switch this early, and didn't know it was stolen, I would consider selling it, because you could get quite a lot of money selling a physical Switch at this point. Admittedly, it would have been worth more before the videos were released of it.

Please don't go on to start a witch hunt, from the same thread someone mentions that the gamesale thing was made before he posted the UI video and at that time he did mention he had to sell it because financial problems or whatever.

He already got it squared with nintendo's legal firm so we probably shouldn't be blowing this up.

of course, and different laws for different states. But I also think nintendo did everything right in this case.

So some people want to throw HHR in jail? Awkward.

whut? i've not read this sentiment in this thread at all. only that it was right for him to ship it back to nintendo. of course he should not be thrown into jail.

Where the hell are you getting the idea that he was the actual thief? Even if he did try to sell it, he could still have been ignorant about it being stolen.

There's nothing particularly shady about him trying to sell it. Both here and in that interview article he said he might sell it since there was nothing he could do with it right now and needed the money for expenses.

A picture and word of reselling got out there and people try to spur the most dramatic narrative. Of course.

I don't think he deserves an angry mob, but honestly saying he did not know the circumstances under which he acquired the Switch were at the very least extremely shady is insanely naive. It's pretty clear this console was most likely stolen from the get-go. People don't just accidentally buy consoles weeks before release from a 3rd party that acquired it via legit means.

Before people start jumping to the 8th conclusion here, he tried selling it before any of the stuff with the UI video was made and he showed off pictures. Not after. People convinced him to keep it and show stuff.

That was the entire reason you got those dank unboxing/ui videos you drooled over.

Yup. The biggest change is that it went from a retailer shipping or him buying from a retailer earlier, to it now being he bought the Switch from a person. The change does make the story a completely different thing.

Yep, would be a non issue without the video..... oh well, seems everything has been handled anyways.
