No it wouldn't. They would have to prove that the person knew it was stolen at the time of purchase. Good luck. I would make them prove in court that it was lifted before I surrendered the product. People have rights.
Pretty sure claiming ignorance as a defense is uh, not a valid defense. There's plenty of precedence for the way it turns out.

Nintendo is fully in their right to demand the switch back. If hiphop wants his money back, that's between him and the person he bought it from, Nintendo doesn't have anything ti do with that.

if not that is lame and I wouldn't mind chipping in a few dollars. Hopefully Nintendo does him right.

Indeed, I'm not upset with Nintendo or anything it's just the first time I've ever heard of a large company personally confiscating something like this from a person. They are well within their right to do so, it's just odd to me.

Ah, I read your post above. Sorry if mine came off a little too blunt. Yeah, this happens all the time but it's rarely publicized since it's generally just regular protocol. There's examples of it happening with stolen Steam codes before and I remember it kicking up just as much of a fuss.

I gotta say after reading that topic I'm curious about where it was stolen from, why it was stolen, how many people the Switch swapped hands with before it finally ended up in HHR's hands, etc. I don't think we should pry if he doesn't want to tell us but I'm just curious about stuff like this, lol. There was an article on some website a while back about a guy who leaked a bunch of rap music online pre-release in the late 90s/early 2000s and it was interesting seeing how he was able to do it (he worked in a warehouse where it was being printed) and why.

If something knowing myself i would be probably be even more aggressive on the matter if the other two hw manufacturers pulled the same thing lol

Ok so you DON'T know what happened with the iPhone 4

For reference: an Apple employee was testing an iPhone 4 months before it was revealed. It was left in a bar, someone took it home, and leaked pictures of it. Gawker saw it, and bought the phone. Apple took them to court because they bought stolen goods.

It doesn't actually matter if you know something is stolen when you buy it, if it is stolen at any point during its journey from the manufacturer to your hands, you can get in the shit for buying stolen goods. In a case like this, where it sounds like HHR did not actually realize it was stolen, you can be let off the hook if the company wants to be nice about it. But if you try to dig in and say you legally bought it, you will wind up in court.

I suppose if he Knows the seller personally or can give police info on the sellers that... uhh.... "scammed him" then he could pursue that avenue to get his money back?


ehhhh... he is better off eating the loss i guess.

The burden of proof is always on the plaintiff. Every time. Some of you guys really don't know your rights.

If it went to court the console would assuredly be seized in a raid as well, so all Nintendo would have to do is cross-reference the Serial Number with the shipment they knew was stolen (which they've likely already done, hence why they asked for it back).
 
The part hidden in the random "I'm a barista" post needs to be front and center, none of the other quoted posts mention the fact that this is "clearly" stolen like so many of you are claiming, and the screenshotted post below that he implies it wasn't stolen. So everyone get off your fucking high horse of "LMAO READ THE OP" when the relevant info so many of you are citing is buried as shit.

I would have done the same thing if I was him, give the console back. If the console was stolen, Nintendo has all the laws in their corner, at least in the U.S. Handing it over willingly, beats Nintendo filing an injunction and getting the courts involved.

Mostly cause he is aware he had it 2 weeks early, he didnt get it from a retailer, and he posted videos online that trace back to him.

Ignorance is only a valid defense if the buyer is... actually ignorant of the product

Hes really lucky that he only lost some money

Why? Because he unknowingly bought stolen hardware and immediately cooperated when pressed by the company it was stolen from?

Really? You suspect nothing is weird when someone wants to sell you unreleased hardware over two weeks ahead of release? The legal standard for these types of things is "knew or should have known", which applies perfectly here.

If I were Nintendo I'd still give him a free Switch, though. Just for the positive PR. But it could also be seen as endorsing someone who clearly bought stolen or otherwise dubiously acquired goods.
