Yah. It's not just talking to a cop for an hour and filling out a form. It's a full day of interviews, accusatory to the alleged victim I might add. You tell the story to multiple people who attempt to find any holes in your story, so sometimes they intentionally try to confuse you. Then a doctor will swab your entire body including your cavities. Then a cop will escort you (in the back of their squad car) to your home to collect the items you wore if you've changed. Then they drive you to the alleged perpetrators dwelling and ask you to point out their home. Then it's back to the station for a final interview. Not something many people will do because they regret a drunk decision.

This makes me incredibly happy that all of this occurs or should occur. Rape is incredibly serious for BOTH parties involved; whether false or not.

Another is that there are possibly more support structures and believers of victims in modern society, so more accusations are leveled because victims are supported and don't feel as scared as they would have in the past.

Similar to the "people are so sensitive nowadays". Yeah, sure, could be that, or it could be that we're becoming, as a society, more sensitive to groups that have been forced to just tolerate/put up with bigoted/sexist/etc. bullshit. More people are willing to listen.

All the damn time is in reference to people doing things they regret while intoxicated. I have done plenty of stupid things while intoxicated that I would have never done while sober. The overwhelming majority were just bad decisions, still regretted them the next day.

Gotcha. I thought you were saying that false accusations via regret/drinking happen all the damned time, not just regretting things due to drinking, generally.

Tough case. Consent when going home does not automatically mean consent in the bedroom. But how do you proof it either way.

That said, some of you people in here are really paranoid about being falsely accused.

Yes, and when a man wants to try and ruin a woman's life, all he has to do is assault or rape her, which happens a whole lot more then false accusations.

Its actually incredibly violating having to go through all of that right after going through something that traumatic. But I guess you can be happy about it because it protects dudes.

What's to stop her from simply saying that she didn't consent after the fact? What if she finds me charming and funny with a couple of drinks in her but when she wakes up sober and sees my fat ugly mug staring back she suddenly regrets her decision?

Nah, for bad reason. How many cases of rape are just thrown out? How many do we actually hear about and how many ruin a guy's life? I'm gonna take a wild guess and say the vast majority of cases end up with the guy going scot free.

Back to medieval ages it is, then. Only married people have sex and only for procreation and the whole village beared witness to the act. Great.

And yes, no random encounters for me. I might murder someone, because of my chromosomes. Or reasons. It's too bad that even sex by two conscenting adults becomes a toxic topic.

Random hookups are risky for both parties though. She could also have actually been raped when going home with a stranger.

I think the issue is way overblown. It makes for a good story that gets a lot of views, but it doesn't happen all that much compared to actual rape.
 
Tinder gives you the casual sex you want without the messiness of intoxication.

No, not really. Does it happen, sure, but I cannot imagine this happens often at all. You don't just get to say he raped me and that is the end of it.

I can't really blame them. It's a sure fire way to have your life ruined. And, from what I've heard, convicted rapists aren't exactly treated well in prison.

Really don't want to go dig up statistics on rapists in prison right now, but of those there, what would you wager are there due to a drunk sex at a bar? I'm thinking the overwhelming majority, probably north of 90% weren't some random drunk hook up that turned into rape.

That's certainly another issue. Drunk sex with strangers is risky from any possible perspective. It's just too bad that consent is not enough to prevent false cases like these. So both parties are stuck in a very bad situation and the only logical conclusion would be not to engage in sex at all at some point. Or trust anyone. ( ;( )

Do you know how hard it is to be convicted for rape if you did do it? False accusations are so rare and never go anywhere it's not worth worrying about.

I don't think you get life for rape.

With our Justice system, I would prefer being shot in the head than getting convicted. You are done with your life with one charges, especially with something as serious as this.

uh, except for all the people that get off scot free from actual, very likely or even proven rape charges?

and yes I have a stake in how shitty false rape accusations are too, my brother was a victim of one in college and he was kicked out for a semester. But once the evidence started coming in and it was clear that it was fabricated he was allowed to return with lowered tuition, but yeah I'm sure he would have preferred a bullet in the head instead.
 
Being falsely accused of any crime is fucked up and damaging to that person's character and life, however to act like it's any where close to actual rape accusations that occurs and either doesn't get reported, does get reported but not taken seriously, or taken seriously and the perpetrators either get off or receive light sentences isn't a much bigger problem is being disingenuous.

And sometimes even after the fact which is the point those posters were probably making. Consent is an easy concept except when it gets exploited like that. And while that happens in only a small amount of cases, it still has to called out when it happens.

If your partner says "stop" in the middle of sex, you stop. Period. If you continue, that's rape. If you stop, it's not rape.

The only kind of "grey area" I can see in terms of consent, is if both partners are equally drunk. Hell, I'd find it sketchier if someone completely sober hooked up with someone slightly tipsy, than two wasted people having at it together, because the former suggests taking advantage of someone's lowered faculty and the latter doesn't. If both are wasted, it's fairly ridiculous to claim they both raped each others, so even if both were "incapable of consent" and somehow managed to go at it, well... that sort of cancels it out. Case by case, obviously, and it can be hard to determine if two people are equally drunk as not everyone holds their liquor the same way even if they had similar or identical amounts.

I don't think it's reasonable that both parties need to constantly reaffirm consent once it's been given. If consent is to be revoked once given, the person who is doing the revoking needs to say so and their wishes need to be respected or else it's rape.

And that's insane and entirely unreasonable. Wanna make sure your partner is no longer in the mood for sexy times, keep asking them how they are doin during.

Consent is very straight forward in most circumstances. The only grey areas are when both parties are not in a state of mind to give consent(drunk, high etc).

You're totally right.

IMO - the problem that everyone is afraid of is what happens when consent is revoked after. I've interviewed women who have said, "I wanted them to stop, but I kept going" on more than one occasion. It's hard to tell them what to do at that point because regret is not rape, but it's still a hard situation, one that can cause people to make poor decisions given the gravity of the outcome.

But yes. No, Stop, Don't. If you hear it, cease. If she complains that you stopped after doing so, RUN.

Ultimately it doesn't prove what happened at the dorm. If her story conflicts with the video evidence then her credibility takes a big dive, but in general these types of he said she said cases seem impossible to get right all the time.
 
I understand. but false claims are exceedingly rare. don't lose the perspective that women have a lot more to fear from casual sex than men.

Without a video taken by chance this one would have never been filed as a false claim (malicious or not).

Just as it's very difficult to the determine the number of unreported rapes, I think it's just as hard to determine how many are false claims.
 
Women are far more likely to be raped than men, but...

Men are far more likely to be murdered than women. Like, 9/10 of rape victims are female, but 8/10 of homicide victims are male.

Still, the danger women face from being raped can't be ignored.

Yes men are more likely to be murdered than women... of course men are also more likely to also be the murderer.
