Now it has been 11 days. Seller was using some of the 'leftover' credit (no leftover as Amazon don't use up any credit until item has shipped, which it hasnt) to buy games. We are still waiting for Amazon to deliver. We do some back and forth, I asked the seller that if Amazon doesnt provide a response by early tonight to issue a refund. I've reached out to that seller, who is active on the site, but have received no response. Amazon reps have told folks with preorders that they would not be getting their shipment on the rumored Oct 11th date.

Thankfully, I sent him the cash via paypal merchant.

What are my options here?

1) Demand a refund from said seller.
2) If seller doesn't deliver refund, post negative feedback so everyone knows who it is.

It's not the seller's fault that Amazon didn't deliver the product (so you can't blame them for that) but you CAN blame the seller for spending your deposit $$$ and not providing a refund when he/she couldn't deliver the product.

A good point. Even if they don’t have the cash in their backup bank account, they can still carry a debit balance in their Paypal account! I had not thought of that

Yes. If Amazon fails to deliver on the pre-order, it's the sellers responsibility to make it right. If you don't get your money back soon, I'd just request the refund from paypal and leave negative feedback.
