I hope it happens, I love the series amd it's one of the few times where I want to play every game/spin-off of a franchise. I also sincerely hope the game to be way much better than the mediocre AAI.
They probably correctly realized that AAI2 would be incredibly hard to get out to retail by the time the localization was done.
The problem is that admitting that makes them look bad and greedy. So they lie. They lie and they lie and they like. And this can apply to basically...well, anything Capcom USA has said in the last two years.
More to the point, any claim that they are trying to get the game ported to 3DSware or something, even if it's 100% true, would absolutely fall on deaf ears. Capcom Japan won't do it because Capcom USA asked. Even if we assume that Capcom USA has been truthful for so long, it means they are at best massively misinformed and at worst incredibly incompetent. That is, as I said, assuming they are not lying.
At this point, just telling the truth of "It was a generational transition, no store would have taken it, direct orders would not have justified the cost, we're sorry but these are special circumstances that do not affect the future of the series," would be a smart move. But they won't, because they've dug in and they'd rather give a dismissive handwave of "We're still trying! " than the truth and a few weeks of furor over it.

The fan translation is apparently up to the third case with regards to the actual translation work.

Sven from Capcom made some new comments on AAI2's chances for a US release during the last "Ask Capcom". Again he said that he's still pushing for it and the talks with Capcom Japan continue and that he's "encouraged" and "optimistic".
Though he did reiterate that it won't be in the near future and that a DS release is still not in the cards. (This is inline with what he had previously said.)

Sven did say in the stream that they don't keep just keep telling us to be patient with MH (and other titles in general) just to string us along. He said he'd rather say as much as he's allowed to as opposed to saying nothing at all. (He doesn't like "silence".)
If they actually have no plans to localize it, answers like his serve no purpose. It would be better to just flat-out admit that it's not coming like Sega did with Valkyria Chronicles 3 rather than slowly foster anger and resentment among Ace Attorney fans.
