Nintendo of America files "reapplication" for Eternal Darkness trademark

Maybe nothing. If something, GCN VC. Won't be picking it up again though. Played through it in Dolphin at 1080p not too long ago and it worked a treat.

I'm a bit mixed on the kickstarter. I loved the original, but I'm not sure that SK in its current state could recapture the feel. To be quite honest, I'd rather see Retro's take on the series.

I guess there's always the rest, but I'm willing to give the original team a chance, or the sort of original team anyway.

It'd be nice if it got a proper HD remaster, since I can't imagine that the FMV even remotely looks good these days, but then they'd charge $50 for it.

What the heck is going on here? Is the Shadows of the Eternals kickstarter a real life insanity effect?

Also, a Retro developed ED? Drooooooooooooooooooooooooooooooooooooooooooool. I never considered it before, but that would actually be pretty cool.

Retro is busy finishing Donkey Kong Country Returns 2 before moving on to Donkey Kong Country Returns 3.

This wouldn't have anything to do with that Kickstarter that started up a lil while ago would it? Either way it goes, I just hope it leads to more games from the series.

Nintendo of America on the 23rd of July filed/reapplied for a trademark regarding the Eternal Darkness franchise. It's a new filing and not a change to the prior trademark (serial number 77932350, filed in 2010). The application was entered in the Trademark Reporting and Monitoring System (TRAM) on the 26th of July.

However, the earlier trademark saw its fifth and final ITU Extension Approval in December last year, so this new application could simply be a continuing measure. Some minor differences exist in terms of Goods & Services between the two marks, but nothing important. Anyway, there's obviously some interest from Nintendo about Eternal Darkness as I doubt they would be making yet another filing for it without. Hmm, maybe when Retro is done with Tropical Freeze...

Dont you dare play with people's heart like that with a Retro/ED collaboration lol.

Would be a great game to have for the launch of the GameCube Virtual Console.

While they're at it, why not secure Shadow of the Eternal as an exclusive?

Insanity effects dude. Not the same on PC.

The only insanity effect that got me was the volume turning down since that was a fairly standard volume graphic for TV's at the time and was how my TV's volume control looked. So long sentence short, it wouldn't work on today's TV's anyways.

Retro is busy finishing Donkey Kong Country Returns 2 before moving on to Donkey Kong Country Returns 3.

*sigh* Well they do have two teams now I guess.

I know Dyack's a douche but....that looks pretty damn awesome. I'm a sucker for a slightly cartoony but realistic style. And the story telling and puzzle adventuring in the first was too good for one game. Plus the horror. Fuuu. I might back it. :(

EDIT: I see there's a thread for it, cool!

I thought that was killed, first by the apathy of everyone and then doubly from the child porn issue.

Does the wiiu TV app need/ask for your TV make/model? Had a wiiU for months and never used it.

I love Eternal Darkness but I never got to beat b/c my friend/roommate saved over my game and I he said he would play up to where I was again but i wasnt havent it b/c it woldnt be the same. If your wondering where I was in the game it was at the part where you got to fight the guardian here. but the green one.

Hmm. If Shadow of the Eternals hadn't just restarted their Kickstarter, I'd say this was a sign Nintendo gave in & funded the project under the original title.

But since that isn't the case, this is just another trademark renewal. Nothing to see here, folks.

WOW at the no fun police in this thread.

1) ED on Virtual Console?? That's what we call a win people!

2) if Nintendo re-acquires the license, what's to stop them from sitting on it until Retro or X studio is free to work on it? ED on VC would make enough money at least for a while, right?

Maybe it's just because Nintendo has the best catalog, but the VC seems like it kicks fucking ass lol

We have yet to see GameCube games on VC. Eternal Darkness wouldn't have a too high priority then anyway.

Nintendo had the chance to work on ED2 for the past 3 years with the original studio, which they semi-own and which is now basically dead, as exactly that studio pitched that title to them and is trying to fund it with a Kickstarter now.

The current team at Retro has little experience with story-driven games. Also I question their ability to produce a game in a 3D world as various lead developers have left since the completion of MP3 and DKCR.

Update (on 31st of December, 2013): Notice of Allowance (NOA) sent (issued) to the applicant. Applicant must file a Statement of Use or Extension Request within six months of the NOA issuance date.

An SOU may not be filed more than thirty-six (36) months from when the NOA issued.

Hopefully we will see something new regarding Eternal Darkness within one and a half three years.

But now with the TVii capabilities of the WiiU a new ED game can actually turn down your volume :p

That would have to be a Wii U port, most definitely. Or maybe just a Virtual Console release, who knows (if Nintendo does release Gamecube games on that platform at some point).

Haha, that would be amazing! The sanity effects were just so unique and awesome. My favorites were when bugs would crawl on the screen, when the game would act like you finished the demo of the game, when you would revert to the main menu, and definitely when they pretended to delete your file. So awesome.

I had a dream after listening to the ED episode of Watch Out for Fireballs.

Nintendo was producing a REmake style reimagining of ED, with expanded
levels and some new chapters, including the Elizabeth Bathory storyline from SofE
and the cut content from ED (like the yellow god).

What does this mean?
From USPTO's glossary:

NOA - a written notification from the USPTO that a specific mark has survived the opposition period following publication in the Official Gazette, and has consequently been allowed for registration. It does not mean that the mark has registered yet. Receiving a notice of allowance is another step on the way to registration.

Notices of allowance are only issued for applications that have been filed based on "intent to use". The notice of allowance is important because the issue date of the Notice of Allowance establishes the due date for filing a statement of use. After receiving the Notice of Allowance, the applicant must file a statement of use or a request for an extension of time to file a statement of use within 6 months from the issue date of the notice. If the applicant fails to timely file a statement of use or a request for an extension of time to file a statement of use, the application will be abandoned.
It means that if they want this trademark, they have to in one way or another within 36 months come up with a game related to Eternal Darkness.

And what Dascu wrote.

Interesting if true.

I can't be the only one who's worried about how the GameCube games will be emulated, given that the NES Wii U Virtual Console games look & sound horrible.
