CandySwipe Creator Writes Open Letter to King

I feel sympathy for him but he cannot really blame King if he hasn't made a lot of money off the app considering it has been out on the store for 4 years and as he mentions often enough, was out for 2 years before candy crush was.

He's not blaming king for it not making money. He's blaming King for trying to stop him making money off of a game he created and released two years before king did their thing. And now king are tyring to say that they are the ones who should be getting money from it because they own the word candy.

They are fucking scum and should be paying this guy.

The outcry is more about how a game, as you point out, out for two years before candy crush is forcibly taken down because it confuses people and steals the king's money.
 
If he has a trademark for Candyswipe, I don't really get the issue. He was there first so his trademark should take precedent over King's.

Actually, and i've never watched or read, but you made it very clear that something terrible will happen to him. That's not the same as stating he exists.

That would have been the case, though I'm guessing that since King went on to purchase the rights to Candy Crusher which pre-dates Candy Swipe (but is unrelated to it), they used that to fight Candy Swipe's trademark

So, three months after the original application (which was AGAINST King) they went back as far as they could to find the first 'Candy' related trade mark IN CLASS 9 that was still active and used their financial muscle to purchase it. Now that they own the rights to the mark that predates CandySwipe, they can amalgamate the usage of their two marks (Candy Crusher and Candy Crush Saga) and they now have priority over CandySwipe.

Horrible, and morally shitty, but very, very clever. And legally, it's a winning move. The end, thanks for playing, where's the next poor prostitute I can go and torture.

King are obviously being devious as fuck but I wouldn't be surprised if they offered this guy money to give it up first and he asked for more or something and that's why they ended up screwing him over. And he's kind of blatantly playing up the dedicated to his mother thing too for sympathy which I kind of don't agree with. Hmm.

Yes I agree King are doing shitty businessy things, whatever, I don't think that's up for debate at this point, and I'm not defending anything they did. I just don't feel like the appeal to people's sympathy is really all that genuine and I don't think people should take things like this open letter at face value without questioning it a little bit, how many more downloads his game got because of this? Just sayin'

Im not saying he should've accepted their offer if there was one, I'm saying it wouldn't surprise me if there was more to this story than he was letting on for the sake of getting as much sympathy as possible which is kind of shady too imo.

No but if you're shitty car was only worth $500 in the first place and then you wrote a sad story about how some asshole stole your car the day after your hamster died, left the part where he offered you $1000 first and ended up getting $2000+ in donations by preying on people's sympathy I'd probably try and say hey guys maybe don't give this guy any more money

the part about his mom is a red herring; the crime here is that his IP was stolen, plain and simple.
