Seeing as the ISP would be involved in this, they surely checked the IP time.

I suppose. I just assumed that they were working independently from the ISP since he's back online while this other firm still thinks there is a problem.

If it's anything like it is in the UK then it's just a scare tactic to get money from you. A handful of law firms did it here, sending out thousands of letters threatening to take them to court unless they paid up. No one ever got taken to court though since they couldn't prove which person did it. The advised course of action was to send them a template letter denying everything.

English law is different from American law. There are people with valid and appealed judgements against them for downloading music.

Right, which is why the OP should call the number for the law office that I found that's registered to that address that that company supposedly resides at. And I doubt that company is legit, because the law firm handles divorce/family law as well as immigration law.

The OP shouldn't be scared, there are a lot of websites that can give you information on how to protect yourself from this bullshit. I think Electronic Frontier Foundation (EFF) also helps people who are the vitcims of copyright trolls.

Law firms can sometimes handle the most diverse and random crap. I'd be a little leery contacting them until I knew more. Also OP should have has facts laid out before hand and not deviate from them *

If the person downloaded it and gets sued (not saying the OP) they're hardly victims, they just got caught. Regarding validity, it depends on who is doing the data collection and it can easily be correct.

Sometimes these large buisness complexes house multiple law firms. It could just be one dude in a small office.

These lawyers file these cases in mass OP. Meaning 1 court fee to file against 400 people. This company is hired by, in this case, most likely the porn studio behind the film. They file against a ton of infringers, and reap the settlements. No one fights this because they are scared they will lose. Judges are getting very tired of this because the lawyers are only paying 1 court fee usually instead of a fee per person.

One guy fought this recently and won. Highly suggest you switch isp and forget about this. They want to drag you to court? Let them, they never will. If you have some balls and want to fight, contact EFF.

The company is scamming and attempting to embarrass you, knowing that many men will gladly pony up $300 to avoid the humiliation of a letter coming to their door (not knowing that the company is extremely unlikely to have their home address) claiming they've been stealing porn.

It's the same reason nobody returns penis enlargement pills that don't work. The check will always come from some obscenely embarrassing company name.

tl;dr it's a scam, ignore it and it'll go away.

(Yes, I've gotten bullshit like this, and it goes straight to my spam folder. I'm pretty sure my -actual- porn collection would be enough to prove in court that I'd never download professionally produced straight porn. I mean, ew.)

This is true, it could.. My suggestion in calling would be to leave out any personal details he's told us and just see if they do any of that activity in that office.

Yep. Ars technica has been doing a lot of coverage about these cases. Pretty informative OP you should go there and search their archives.

What's funny, is that some of these "lawsuits" are going on works that the porn company has copyrighted the work, months after its release, even months after the alleged infringement occured.

Some have even attempt to claim copyrights on a derivative product. Meaning "Old Porn movie, scenes mixed up, released by another company with another title, still the same scenes"

I am fighting it. Already told them I am innocent and that if they want anything they will need to take it to court. My company has an attorney on retainer I will just sick them on the company if they send me anything else.
