CDPR Facing Class-Action Lawsuit for "misrepresentation in order to receive financial benefits” [NYT]

I called it on launch day and was met with these responses:

Class action lawsuit? The game performs the same way hundreds, thousands of titles have performed over the years. It’s a super ambitious game.
Class action suit under what grounds? Where did they actually advertise hard numbers that last gen potatoes would hit? Where did they advertise guaranteed performance minimums at all?
Just because something is 'expected' doesn't mean its guaranteed. The only right you have here is to refund (in some countries...).


It was clear as day to me that this would happen since they didn't show the game running on base PS4 and XB1 consoles AT ALL. And keep in mind that those machines hadn't even released when the game was announced, mind boggling.

The game would have been better off on just PS5, XSX/S, PC and Stadia. It wasn't my decision to release it on 7 year old tech, it was theirs. Why is this the consumers fault?/Why are you blaming the gamers here? I'm a PS5 owner so am not remotely effected by its performance on PS4.

The people who made the decision to force this game out should be fired. Too bad we all know the people most responsible won’t get shit done to them. It’s really sad that the devs who put years of their lives into this game had to put out an unfinished game. Only a huge corporation could finance a game this large and only a huge corporation would let greed fuck this up so bad.

Where have I complained? I'm merely disseminating info about the current state of play regarding this piece of shit video game.

Tell me, how could one inform themselves when the dev deliberately withheld footage and reviews of the last gen versions of the game?

It runs ok on some platforms and bad on others. I've played games in worse shape. What they did was scummy, but it's just a $60 videogame so it's not the end of the world. Get the refund they've offered and move on. Check it out again when it's patched or don't bother. Don't buy their next game day 1 or don't buy it at all if it is that big of a deal.

They deserve to be called out but some people and places are going way overboard with the victimhood.

Two questions for you and I won't press you any further

Does every game get pulled by Sony for being a piece of shit?
Does every game hide PS4/Xbox versions because of how poorly they run?

These are what make this case different.

I guess Sony felt the need to do something, but pulling it is very extreme. Still knee jerk from them if you ask me. Wouldn't they have to certify it as fit for purpose initially? It's a buggy game, but it's not bricking consoles or anything.

Once the game is released, they can't hide it. It was very cheeky of them, yes, but surely the lesson here is wait for reviews before you buy. And that applies to anything, not just games!

Remember, these guys didn't force anybody to buy their game!

Come on CDPR. You can get through this. Fuck the haters, the game is incredible, its heart and soul and sheer fucking powerful resonance with what is going on in the world right now cannot be beaten down. It shines through. You've made something legendary, again.

All the people raging over the bad launch and wanting to punish CDPR almost to the point of destruction are pathetic losers and exactly the kind of fucking dickheads you would want to make angry. We'll still be talking about Cyberpunk 2077 in years to come, not because of its bad launch, but because it's an incredible game.

Everyone deserves defending when they're being targeted by a massive overreaction (and consistent harassment from certain circles). They're offering full refunds to anyone who wants them and working hard to fix the game. That should be enough for anyone with a working brain.

The hilarious thing is that you're here cheering for people (investors and lawyers) who are the actual greedy party here, after criticizing CDP for being greedy. Hypocrisy at its worst. 😂

Folk are dicks. The game is buggy, so what? Every game is released with many bugs. Given the scope of this one, more are expected.

The piss poor performance on base consoles? Well that sucks, but reviews have picked up on it, so buyers are informed. If you choose to preorder a game without finding out such basic stuff, then that's on you.

Christ, I grew up with the spectrum and C16/64. Now those had buggy, poor running and unbelievably shit games. But I still had fun with them, just like a lot of people are having fun with Cyberpunk right now.

We are a bunch of entitled fuckers. It's a 50 quid purchase, that we make of our own free will, with every opportunity to research into it beforehand.
And finally we are seeing something being done because these shit bugs.

That alone will make publishers/developers thinks twice before launch bugged games.

As I've already said, I'm not cheering for anybody. My take is that they deserve what's happening in terms of backlash but I don't want to see them go under or for workers to be harmed/threatened at all.

I'm disseminating new information and, admittedly, prodding people like yourself to see why you feel the need to defend CDPR so much. Don't understand your mindset and fanboyism but good luck to you.

This game was stuck in development hell and rushed out the door because fuck you, fuck the developers and fuck Cyberpunk 2077. CDPR turned corporate and those fucking suits have been using their "buddy PC gamer" history to sell us lies while killing everything that the people creating CDPR games stood for.

I still can't understand why they didn't just release the game as 'beta' or 'version 1.0' and tell everyone about the state of development. We have plenty of examples of this type of thing in the industry. Most gamers wouldn't have had an issue with this and would have happily bought and played it bugs and all.

Instead they have a huge mess on their hands. Very very poor decisions made by higher ups on this one. Gonna cost them a lot of money.

If they continue to make games i hope CDPR just sticks to being PC exclusive developer and be done with it, there is no need for them to get greedy and release multiplatform, work to your best potential on your main platform then afterwards if you really want make a console port after 1 or 2 years.
Why is that hard? i mean those Nintendo and PlayStation games are also exclusives and they do well, in fact they receive extra points for being exclusives. (Rockstar console exclusive, Zelda, Mario, The Last of Us, God of war and the list goes on..) Multiplatform games are bound to have many issues. Just drop the consoles if you have GoG and your main platform is PC, focus on giving the best possible experience on PC, add more features and dont cut things because of consoles. After you gain the good reception from journalists and gamers, consider making a console port for console only players. WHY IS THAT NOT A THING ALREADY?
I have all platforms except Xbox one, imo if you love gaming you will own more than one platform to get all games, if you are dedicated to one console only so be it but i imagine PC gamers only dont get to play all games like God of War and its fine nobody keeps complaining, things move on, now do the same and make CDPR games PC exclusives like old Valve.

I’m not gonna defend how awful the launch has been, but I’m not gonna pretend like this is new to gaming either. It’s pretty standard practice for juggernauts such as Ubisoft, EA, and Bethesda, and and while it’s debatable that CP2077 is the worst it’s ever been, it’s not new. CDPR has the unfortunate reputation of being “transphobic,” so it been pretty easy for the media/social media to claim “doom and gloom” and keep the heat coming with the hopes of destroying CDPR’s reputation.

CDPR will prevail. In the long run, GOG will return to being Steam’s main competitor, after Epic has no money left to throw at new games. If nothing else, GOG will keep CDPR comfortable for a long long time. In a couple year’s time, after the release of 2077’s GOTY edition, no one will remember how awful it was the first few months. Just like The Witcher 3.

Also funny to see investor scum wanting CD Projekt's blood when satisfying them is basically the main reason why the whole thing happened.

Not that this is going anywhere, because for such a lawsuit to have any merit, they need to prove that the "misrepresentation" has brought financial benefits, which it obviously has not. These shitty law firms do this every time there's a problematic launch and it never goes anywhere, but hey, it makes for attractive headlines for yellow journalists.

Incidentally, some of you folks with the hate boner against CDP make me wonder if I didn't accidentally click on the purple forum (which I may very well have, since this OP was copied straight from there). 🤔

Who are the "usual suspects", who are "protecting" CDPR and have you conveniently forgotten that CDPR is the developer and the decision to push the game out the door came from upper brass at CDP (the publisher) to please investors/shareholders?

You're right, it's not new....and it likely wouldn't be anywhere near as big a deal if CDP/R hadn't spent years cultivating a good guy reputation. You see if Ubisoft, EA or Bethesda behave like Ubisoft, EA or Bethesda nobody really cares...but if the industry darling, CDPR starts behaving like Ubisoft, EA or Bethesda...
