Thats the beautiful thing about defamation law. Truth is an affirmative defense. However, truth is not a shield from having the aggreived party finding out who you are. Truth doesn't shield you from the lawsuit. You have to prove your case in a court of law. The burden of proof is on the declarant. That is why you have to "be prepared to defend yourself". That is how the law works. If you don't want to be dragged in front of a court in the future, it may be wise not to make factual assertions against companies or individuals.




Partially correct. They certainly had to submit affidavits to each and every user they claimed committed some kind of tortious act against them. I'm sure they did. I actually read their pleadings, and their pleadings have excerpts of those they are seeking to discover. The judge did not mess up, this is how the law is supposed to work. That does not mean that DH will win.

The issue is that their plan is more than likely to force the Steam users to settle since most of them probably can't afford a lawyer. DH more than likely knows that they have no case. They just want to force people to pay them because they have no money.

I don't get this. You're saying that Valve is in the wrong and should just give info to anyone who requests it?

In some ways it seems like a legit case. What do you do when you get bullied, and everyone trashes your work to the point where it sabotages your business? Seemed like all he wanted to do is try to make a living for himself. How is the guy supposed to defend his self? One thing I don't get is that people left hate trails on his games. Why not disable comments? Seems like Valve has a failed system in place. I wouldn't sue for comments or Jim Sterling though.They are just using loopholes in a poorly implemented abuser friendly system that a company should be professional enough to curate.

I see Youtube as the same dystopia. I try to watch a live stream of Apple's event, then see a wall of racist internet graffiti.People think its all a big joke, but when the internet gets censored from the extended abuse, you guys are to blame for not being able to contain your hatred.

There's a simple solution to this, though: start trying to make good games. They want to put in the minimum effort and then bitch and moan when people call them out on it.

In the comments sections of Jim's "Homicide" video, go about six comments down to "Gordon Bennet". The first person to respond to him, "Gulliver Thoday" tells a story about how he tried to tell DigiHom how they could improve their games, and the response was basically "We don't care, we just want to make money."

I believe this is the modus operandi of DH. Throw everything at the wall, pretty much.

In the interview with Jim Romine says almost right away that he has 3 kids, is 35 years old and is an adult. Jim's response "oh dear". lol

So yes, he does have kids, which is scary

Do you really know the complete history with this? I don't mean to attack but I would find it hard for someone to make a comment like this who has followed this story since the beginning and the first video, then all that transpired since. You paint them as these poor victims who are just subjects of being bullied. It's not that simple by any means. They have done a boatload of shady things and perpetuated if not instigated a ton of this along the way.

Im sure this has been linked many times but for the people who haven't listened to Digital Homicide talking with Jim Sterling.... it's actually insane how completely stupid this guy is

like holy shit I'm an hour in and everything he says is just completely wrong. he has no grasp on reality at all.

Man this guy doesn't seem to understand that Jim doesn't have an issue with developers buying assets. He keeps bringing it up over and over again.
 
I, for one, am greatly entertained. I feel bad for the guys' families--imagine being married to them in all this mess...
But imagine them suing GAF next. I guess the real question is who comes after Valve. lel

ISPs for facilitating whatever-DH-are-claiming. Throw in the router and wiring companies too for good measure; can't let them off the hook.
Microsoft for creating the OS that allowed people to play their games and form "wrong" opinions?
Reddit have several threads that aren't being nice to DH, so they're no doubt on the chopping block. 4chan are also have a good laugh about it - lawsuit.
You're probably eligible too for a good frivolous lawsuit for feeling bad for their families.
Guess I should add myself for calling their lawsuits frivolous on more than one occasion.
Honestly, if they tried to sue the real Karl Pilkington, I wouldn't be surprised at this point.
 
DH was done with Valve anyway. Valve's new refund policy meant DH wasn't able to sucker people into buying their games any more. Since they're done with Valve they have nothing to lose by attacking them or their customers. They expected Valve to shut them down.

Stop delivering garbage work. Suing people for calling your product/you shit doesn't work in the US.

You have a store. You sell products for companies. One company keeps poking its head in the store and harassing the customer.

So as a store owner you stop selling said product.

Im really confused wtf they can sue valve for.. this isnt the first time Valve has booted a dev off their store and I am sure it wont be their last.

Hey, if Valve wants to put an official seal of approval on games, then that's one thing. Steam allows shovel ware by the mountain loads. If it's not really a free market, then maybe it needs to be addressed more.

This was obviously the next step these guys were going to take and I'm sure Val e also expected this and prepared accordingly. I really hope they get laughed at and Valve doesn't just settle this out of court. These guys have no idea what they are doing and deserve not to be able to sell their crap on Steam. Maybe they can learn from this Experiance and actually create something that isn't just cash grab shovelware. I bet if they actually tried to make something fun and worthwhile they might get a second chance. But if they continue with this attitude they will have more problems in the future with this kind of outlandish behavior.

I know your playing devils advocate, but no. There is no legitimacy here. This is just another frivolous lawsuit they are filing that will waste people's time and money.

Their actions put valve well within the right to remove their content from its services. Valve wasn't the one making negative comments. Their customers were.

There is no legal compensation for customers hating your product.

I could see negative comments being OK, but maybe he was attacked in many different and personal ways. I see stuff on Youtube all the time. It should be against corporate policies to allow for abusive harassment.

Honestly, given their track record at this point, is anybody surprised at what DH is doing? When I heard the news, I kind of just... shook my head, sighed, and went about my business.

Of course, when they eventually lose their "lawsuit", I'm sure they'll want to try and sue Tim Berners-Lee for his hand in creating the internet. Hell, why stop there? Dig up the bones of Marconi and Bell and see if you can sue for telecommunications altogether.
