Haha, I was just looking back at some old updates (pokemon trainer) and noticed that his standing spot on the Battlefield stage is also where snake was hiding during the first trailer, I wonder if the inevitable box move will put snake out of play into the back of the stage? :lol

so far most of the things in that first trailer we never thought would be in the actual gameplay have come to fruition (zero suit after final smash, wario bike, pit aimable arrows etc.)

EDIT: I realy wish for the inclusion of one or more characters from Capcom, but not Mega Man (I'm tired of the guy, c'mon! ). Joe is one, Leon or Jill from RE could be another...I'd even take Zack (although, that'd be for the next iteration of Smash Bros.)

I expect simple palette swaps again for the most part, maybe some accessories to discern the chars more easily if necessary - more elaborate maybe, but essentially similar to how Melee did it.

But thinking about it, that could be a nice update in the future: 'alternate costumes' with some examples given.

I believe that it is actually third party. iNiS is known for a variety of games across all platforms, notably Gitaroo Man (PS2, PSP). Nintendo just publishes the game, and iNiS keeps it exclusive to DS (not like it'd work anywhere else).

I'm looking it up and I can't find anything that says it definitively either way. The closest we get is here:

At the 2007 Game Developers Conference in San Francisco, iNiS Vice President Keiichi Yano described the process which eventually resulted in Osu! Tatakae! Ouendan. His first inspirations for the game came when he first tried a Nintendo DS handheld, and development on the game began after successfully pitching the concept to Nintendo. At the conference, he also displayed early concept art for lead Ouendan character Ryūta Ippongi, who originally wore the shirt of his gaku-ran uniform unbuttoned and had a significantly shorter hairstyle. Yano noted that Nintendo was fond of the characters due to their manga-style aesthetic.

So they pitched the idea to Nintendo, probably to get publisher support, but does Nintendo actually own the characters? They were obviously iNiS' design...
