I think it's apparent Microsoft could less about markets outside of the US...and gamers.

Where did this rumor surface? I ask because it would likely run afoul of trade laws in the US as well, and makes no sense if I can buy a game directly from the XBL marketplace.The main issue is with the rumors of the used games and only allowing to sell it back to a Gamestop and removing private sales. There is no way that will get through in EU laws because it's basically colluding and price fixing on what you can get for your game when you sell.

Considering lawyers who specialize in these issues have no idea what the implications of the ruling are or how ECJ would decide if the circumstances were slightly different (for example if the service aspect was more significant), it's better not to draw any definite conclusions from the case. Even if we take the ruling at face value, it's fairly trivial to get around it by tying more and more services and features like cloud into your product. I think people who are making comparisons between Digital content like Steam/ iOS games etc... and physical Disc media are completely missing the point.
With a physical copy of a game, EU law is quite clear, you relinquish all IP rights when you sell the game in regards to who owns that particular copy. This means the purchaser can do what ever the like with it, as long as they don't break other EU laws such as piracy, copyright and trademark violations.
