Since his fall, Freddy has been in a medically induced coma, and thus been unable to give cops more information that could contradict Aska’s claims, and bolster the case against him.

That changed in the past several days, when Freddy was removed from life-support equipment at New York-Presbyterian Hospital, began breathing on his own, and came out of the coma, the source said.

“It’s unbelievable,” said Steven Hymowitz, a lawyer for Freddy’s dad, who is also named Freddy Martin. “God was certainly with him.”

Freddy since has been interviewed by detectives. It is not known what he said."


It also mentions that they're filing a lawsuit against the apartment owners too.

Just found this. This is from last night, unless something has drastically changed(and it is possible), Freddy's family said he will live. :)

Aska is saying it is an accident.

The twisted teen accused of pushing his 9-year-old neighbor off the roof of their five-story Bronx apartment building told cops it was an accident — but admitted he didn’t go for help.

“I grabbed Freddy around the legs,” Casmine Aska, 17, said, referring to victim Freddy Martin, according to court papers.

“His feet were off the ground. I turned around. I slipped and Freddy fell. I did not call 911. I did not tell my mother. I did not check to see if Freddy was okay.”

Bizarrely, Aska said, “I did not hear the thud until I went into the apartment.”


Prosecutors say Aska dragged Martin up the stairs of their building on Nelson Ave. in Morris Heights on Friday, picked the boy up and threw him off the roof.

Before losing consciousness, Freddy managed to tell EMTs, “Cas dragged me to the roof and threw me off — I don’t know why,” according to court papers.

Aska’s lawyer, Katherine Dyer, insisted in Bronx Criminal court Sunday that the plunge was “a tragic accident.” She described the teen as a dedicated high school student and church volunteer.

Aska has four prior arrests related to robbery, assault, harassment and menacing, law enforcement sources said.

Aska was ordered held without bail. He asked to speak to his teary-eyed mother as he was led from the courtroom.

Martin, who loves baseball and painting, remains on life support and in a medically induced coma with collapsed lungs and a broken leg, arm and ribs.

He is expected to live, according to his family.


“My son is very strong — he will survive,” said the boy’s father, Fred Martin, who spent Sunday at his son’s side at New York Presbyterian-Columbia Medical Center.

“It is a miracle.”

A 9-year-old desperately pleaded, “Stop! Stop!” as a callous teen neighbor dragged him to the roof of their five-story Bronx apartment building and chucked him over the ledge, cops and witnesses said Saturday.

“Mommy! Mommy!” Freddy Martin cried out, unable to move, as he lay on the concrete sidewalk in front of the Nelson Ave. building in Morris Heights, witnesses said.

“I looked out the window and was scared,” said neighbor Wanda Simonetti. “I saw his body on the ground.”

Emergency workers initially suspected the critically injured boy took a spill from the fire escape outside his third-floor apartment around 8:30 p.m. Friday — until he managed to tell a cop that he was pushed, police sources said.

Before losing consciousness, Freddy told the officer during an ambulance ride to New York Presbyterian-Columbia Medical Center in upper Manhattan that a neighbor, Casmine Aska, tossed him off the roof of the brick walkup, the sources said. “The kid told a cop, when they were going to the hospital, that he was thrown from the roof,” a source said. “The boy named the suspect.”

Once the child arrived at the hospital, doctors placed him on life-support. He remained in grave condition with severe body trauma on Saturday.

Investigators later learned that Aska, who lived on the fourth floor, grabbed the child from his apartment and dragged him up to the roof, sources and witnesses said.

Freddy’s grandmother, who was baby-sitting him in the apartment, didn’t immediately realize the child had even left the home. She told neighbors the boy was lying down and disappeared after he got up to get a drink.

“(Freddy) was screaming,” said one neighbor, who ran outside her first-floor pad when she heard “a commotion” upstairs. “He was saying, ‘Stop!’ ” said the neighbor, who did not want to give her name. She said the echoes of “laughing and hooting” sounded like a group of kids horsing around in the hallway.

But when she peeked up the stairwell, she saw two youths wrestling. Dismissing the rowdiness as part of the usual child’s play that occurs on the roof, the neighbor went back to her apartment.

“That door (to the roof) is always open,” said Wanda Simonetti. “People have complained to the super, but nothing happens.”

The presumed shenanigans came to a tragic end when everyone in the building heard the child screaming for his mother — and saw his little body sprawled on the sidewalk.

The 5-foot-9, 165-pound Aska fled into a neighbor’s apartment. But a short time later, a cop grabbed him as he tried to walk out with his mother and a brother, sources said.

The 17-year-old Aska, was taken to the 46th Precinct stationhouse in University Heights, where he told detectives conflicting stories. “He gave several versions,” a police source said.

Aska, after initially denying he played a role in Freddy’s plunge, told cops the boy accidentally fell off the roof, sources said.

Aska, who said the pair had been talking about a video game, acknowledged going to the building’s roof and walking to the edge. He told cops Freddy walked toward him. “He said Freddy tried to grab him and in doing so fell from the roof,” the source said.

Sources said there’s “physical evidence” showing Freddy was dragged from his apartment and pushed off the roof, and Aska was charged with attempted murder on Saturday.

“They’re detaining my son,” said a woman who identified herself as Aska’s mother outside the precinct building. “They won’t tell me anything. They won’t let me see my son.”

Wearing baggy black pants, a black coat and glasses, Aska was escorted from the station about 8:40 p.m., his hands cuffed behind his back. He ignored reporters’ questions as cops loaded him into a car.

By 17 year are 99% an adult in terms of making rational decisions. Inexperienced maybe, but not incapable of understanding that throwing someone off a roof is wrong.

Shocked that he was handcuffed? A good kid? With four fucking priors?

I tend to think the more shocked they are the more culpable they themselves are to these peoples behaviours. But thats maybe unfair.

Standards are dropping faster than a piece of debris falls into a black hole regardless of whether or not this kid committed the crime.

on a serious note, family members always give the 'but he is a good kid" line all the time. If you kid has run ins with the law more than once, there is probably something wrong with your kid. A kid can make a mistake, but 4 times is another story.

I'm surprised, and glad, he was able to survive the fall. Hopefully he pulls through.

Do you have any family members with chronic problems with the law? drug addiction issues? assault? I do.

At some point you have to realize that not calling them out on their behavior is enabling it and making it worse. You can love your family member, but still realize and drill it into them that "hey, what you do and who you are is not good, and it's not healthy." people that still turn a blind eye and use the "oh, but he's a good boy" routine only make it worse. There ARE good people who do shitty things in moments of weakness. This is not one of those cases.

I'm sure many of these people have happily bailed him out or given character witness statements about what a good person he is at heart, hoping that he'll get the message THIS time and clean up his act. it rarely works this way in practice, and its sad to see it.
