While it borrows color schemes, and has a general Mario plot, it never actually explicitly references anything Mario. Even then, at this point I don't think Nintendo would bother fighting anything that wasn't incredibly blatant (as in using character names and everything) for fear of the Streisand Effect (if you pay attention, they haven't gone after any of the current Pokemon Go scenes popping up either).
