3. I'm the furthest thing. I have it on PC and console. But it's objectively not very good on console (Series X). I know this because I have both.

they did not misrepresent anything to a criminal degree because they did not show any last gen console footage which was fake. case closed imo.
from what i can tell, the most they did was make statements that the game "ran well". which, it is a game that makes high end PCs struggle. they could easily argue that it ran as well as you could expect given the hardware limitations. obviously even to get it running smoother at a faster framerate, the visuals will have to take a hit. this is a game made with modern generation and PCs in mind.
at no point did they claim that last gen consoles ran as well as this gen. which seems to be the giant leap this lawsuit is claiming they are responsible for. this has no legal standing, correct? are they going to be legally punished for not making all 7 ports perform the same? that's stupid.

CDPR worshipers blaming the consumers and making excuses for their beloved CDPR gods is a hilarious sight to behold but also baffling at the same time. These types of individuals belong on the same shit list as people who believe the earth is flat. I myself am enjoying some aspects of the game on a PC, however, it's absolutely ludicrous to disregard the indiscretions (and even transgressions) made by CDPR. In addition to the various performance-related issues found mostly on previous gen consoles (CDPR shouldn't have even bothered with developing their next-gen title on outdated hardware and that is their fault that they decided to do so due to their greed and shortsightedness), the final product they released is not reflective of what they've been marketing and advertising to the public for the last 2.5 years. Perhaps CDPR shouldn't have also wasted their resources on hiring Keanu Reeves since he doesn't even look like the Johnny Silverhand character in the original source material, Cyberpunk 2020. And let's be absolutely honest here.... he's a terrible voice actor (One could even argue that he's a mediocre actor in general at best, period).

The first two Motorstorm games had demos, at or before release - not sure about the third but pretty sure it did too - so consumers could try before they buy, and each demo was representative of the final game, and was a quality product.Are we still in time to file a lawsuit against Motorstorm?

I suspect this was something put together in the case that CDPR doesn't follow through with the good faith refund promise in some way.This class action lawsuit wouldn't stand a chance in court. Considering they offer refunds and to fix the issues. Nobody could claim "fraud". Not only that, but good luck proving that the game was supposed to do something that it currently doesn't. outside of bugs, I don't know what leg any legal action could stand on.

The problem CDPR have in this situation (IMHO) is that their own shareholders will potentially treat the state of the game (on the largest platform it would earn money, the PS4) as insider trading info. Shareholders being informed that the game wouldn't meet well established technical software engineering metrics for HD interactive frame-rates for the genre it occupies is far more than whether the game is rubbish or not - and I'm not talking for the occasional drop here or there, or pacing issues.
Any PS4/X1 game of this type, and this late in the generation is expected to technically achieve a frame-rate avg above 25fps and at a resolution above HD ready(720p), but closer to Full HD, and have IQ that matches around the average games of the generation at the development budget level it used(eg AAA, AA, A). No of those criteria appear to have been met on either the PS4 or X1, and as such the game wasn't ready at a technical level to publish on high profile console platform like Playstation or Xbox IMO, and those responsible for the company must of know that only too well IMO.
Had investors been made aware that the game was rainbow chasing buzzword graphics fx to the point of crippling the IQ and frame-rate of the versions of the generation hardware it was supposed to be releasing on- it is a last-gen game after all - then investors would have probably dumped shares at the earliest opportunity to recover their investment for a product that wasn't going to give them the ROI they had hoped.
Sony pulling it from PSN and offering refunds - because in the UK anyone taking them to a small claims court would have an easy task getting a judge to agree the game isn't of merchantable quality on the disc or even after updates if bought digital - IMHO gives shareholders a valid point of grievance.

Just because I like the art design on this particular avatar, it doesn't necessarily mean that I worship CD Projekt Red. And if you think the comparison between GTA: San Andreas and Cyberpunk 2077 isn't valid, then consider the fact that Cyberpunk 2077 was marketed and advertised as an expansive open world with emphases on customization, open-world exploration, and immersion, while also including dynamic AI with each NPC having their own day-and-night cycles. So if you even bothered to watch the video I linked, you'd be able to conclude for yourself that as far as immersion and expansive open worlds go, GTA: San Andreas does a better job than Cyberpunk 2077 in regards to the aforementioned aspects.
