That would explain why I can't access the free version of Saints Row 4 (new One owner, just addes the 14 day gold trial for now, worked with the free One games), but a friend of mine, who has a long suscription, has the same problem: instead of getting to "buy" the game for free, he gets to where he has to enter payment options, which surely shouldn't be needed, should it? It isn't for the One games after all.

Any idea whats going on and how to get these games?

It's required for 360 games unfortunately, as other guy said, just tell him to attach a paypal if he doesn't want to add card details.
